Ankara Üniversitesi Avrupa Birliği Ekonomi-Maliye bölümündeki Yüksek Lisans çalışmasını, 2005 yılında “Merkezi ve Doğu Avrupa Ülkelerine Yönelik Avrupa Birliği Mali Yardımları ve Türkiye” başlıklı tez çalışması ile tamamladı. Ankara Üniversitesi Araştırma ve Uygulama Merkezi (ATAUM) tarafından düzenlenen Uluslararası İlişkiler Uzmanlık kursuna katılım sağladı ve kurs sonunda hazırladığı “Tek Pazardan Tek Para Birimine: Avrupa Tek Pazarına Geçiş ve Maastricht Antlaşması” başlıklı çalışması birincilik ödülüne layık görüldü. Bu süre zarfında, Mali Kontrol ve Mali ve Bütçesel Hükümler fasılları ile Fiscalis Programı’na odaklandı ve AB bütçesi konusunda eğiticilerin eğitimi programını tamamladı. İyi derecede İngilizce bilen yazarın Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı yayınlarına ve e-bültenine katkılarının yanında yayınlanmış makaleleri bulunmaktadır. 4 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı I. FISCALIS Programı Hakkında Genel Bilgi vrupa Birliği’nin aday ülkelere yönelik katılım öncesi stratejisinin unsurlarından biri de, gerekli kriterleri karşılayan aday ülkelerin AB’nin Program ve Ajanslarına katılmalarının sağlanmasıdır. Bu Programlardan biri de, vergilendirme alanındaki Fiscalis Programı’dır. A AB sınırları içerisindeki iç pazarın etkin işleyişinin sağlanmasında en önemli araçlardan biri vergilendirmedir. İç pazarda vergilendirme sisteminin işleyişi, özellikle de vergi kaçırma ve vergiden kaçınma ile mücadele, rekabetin bozulmasının önlenmesi ve idareler ile mükellefler üzerindeki yükün azaltılması açısından önem taşımaktadır. Buradan yola çıkarak, ulusal idareler arasında işbirliği, bilgi değişimi ve en iyi uygulamaların paylaşılmasını sağlamak amacıyla, vergilendirme alanında Fiscalis adı altında bir AB Programı oluşturulmuştur. Fiscalis Programı’nın temelleri, dolaylı vergilendirme alanında çalışan kamu personelinin mesleki eğitimi için oluşturulan Mattheus programı ile atılmıştır. 1993 yılında başlayan bu program 1998 yılında ilk Fiscalis Programı’nın başlamasına kadar geçen zamanda Üye Devletler arasında bilgi ve personel değişimini sağlamıştır. 1998-2002 yılları arasında yürürlükte olan ilk Fiscalis Programı, yine dolaylı vergilendirme alanında işbirliğine yönelik faaliyetlere katkı sağlamıştır. Bunun ardından, 2003-2007 yıllarını kapsayan Fiscalis 2007 Programı yürürlüğe girmiş ve kapsam genişletilerek, dolaylı vergilerin yanı sıra doğrudan vergilendirme ve sigorta primi vergileri alanlarında da faaliyetler yürütülmüştür. Tüm bu Programların iç pazarda vergilendirme sistemlerinin etkin işleyişine büyük katkı sağladığı konusunda hemfikir olan AB yetkilileri, programın devam etmesi yönünde karar almış ve şu an yürürlükte olan ve 1 Nisan 2008- 31 Mart 2013 dönemini kapsayan Fiscalis 2013 Programı başlatılmıştır. Fiscalis 2013 Programına ilişkin 1482/2007/EC sayılı Karar, 15 Aralık 2007 tarihli AB Resmi Gazetesi’nde yayımlanmıştır. Söz konusu Kararın tamamına Ek-3’te yer verilmektedir. Programın ana hedefleri, - Özellikle KDV alanında vergi kaçakçılığı ile mücadele; - AB bünyesinde en iyi idari prosedürlerin ve uygulamaların gelişrilmesi ve - Ulusal vergi idareleri arasında bilgi değişiminin sağlanması olarak belirlenmişr. 5 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı Program, katılım öncesi stratejiden yararlanan aday ülkelere ve potansiyel aday ülkelere de açıktır. Halihazırda katılımcı ülkeler, 27 Üye Devletin yanı sıra Türkiye, Hırvatistan, Makedonya ve Sırbistan’dır. Program Kapsamında Düzenlenen Faaliyetler Program faaliyetleri 4 ana başlık alnda gerçekleşrilmektedir: 1- Katma Değer Vergisi 2- Özel Tükem Vergisi (alkol ve tütün ürünleri, enerji ürünleri) 3- Gelir ve sermaye üzerinden alınan vergiler 4- Sigorta primleri üzerinden alınan vergiler Program çerçevesinde düzenlenen etkinliklere sadece katılımcı ülkelerin vergilendirme alanında çalışan kamu görevlileri katılabilmektedir. Fiscalis Programı kapsamında yukarıda sayılan her bir ana başlık altında aşağıdaki türlerde faaliyetler gerçekleştirilmektedir: 1) Seminerler ve Çalıştaylar: Seminer ve çalıştaylar, ulusal idarelerde çalışan kamu görevlileri, Komisyon temsilcileri ve gerektiğinde diğer uzmanların katılımı ile, belirli konularda bilgi alışverişi için bir temel teşkil etmektedir. Seminerlerin sonucunda yürürlükteki AB müktesebatını geliştirmeyi veya değiştirmeyi, ya da idareler arası işbirliğini güçlendirmeyi sağlayacak tavsiyeler ortaya çıkabilmektedir. Çalıştaylar da aynı nitelikte olmakla birlikte seminerlere göre daha kısa sürmekte ve daha az katılımcı ile gerçekleşmektedir. Seminerler ve çalıştaylar AB müktesebatı ya da bunun uygulanması konusunda düzenlenmekte ve bu faaliyetlere her ülkeden belirli sayıda temsilci davet edilmektedir. Programın içeriğine göre bazılarına tüm katılımcı ülkeler, bazılarına ise yalnızca Üye Devletler katılım sağlamaktadır. Seminerlerde genellikle İngilizce, Fransızca, Almanca ve ev sahibi ülkenin dilinde simültane çeviri imkânı sağlanırken, çalıştaylar sadece İngilizce olarak yapılmaktadır. 2) Çalışma Ziyaretleri: Komisyon ve üye devletler, vergilendirme alanında çalışan kamu 6 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı görevlileri için çalışma ziyaretleri düzenlemektedir. Her bir ziyaret Fiscalis kapsamındaki belirli bir hedefe odaklanmaktadır. Çalışma ziyaretleri ülkedeki vergi sistemini tanıtmaya yönelik genel, veya sadece belirli bir konuya odaklanmış spesifik grup programları şeklinde olabileceği gibi, talep üzerine, bir ülkedeki belirli alanda uygulamayı öğrenmeye yönelik daha dar kapsamlı ve ihtiyaca özel hazırlanan ziyaretler şeklinde de düzenlenebilir. Çalışma ziyaretlerinin süresi değişmekle birlikte genellikle 5-10 gün arasında olmaktadır. Bir ülkenin ilgili yılda çalışma ziyareti düzenleyip düzenlemeyeceği veya ziyaretin konusu, süresi, vb. gibi bilgiler her yıl ilgili ülkenin tercihine göre belirlenmektedir. Çalışma ziyaretlerine, seminerler gibi her ülkeden belli sayıda kişinin katılımı söz konusu değildir, katılımcı sayısı ve katılımcı profili düzenleyen ülke tarafından belirlenmektedir. Ziyareti düzenleyen ev sahibi ülke, diğer ülkelerden iletilen başvuru formlarını incelemekte ve düzenlenen programla ilgisine göre başvuran kişiler arasından seçim yapmaktadır. Çalışma ziyaretleri genellikle İngilizce olmakla birlikte, bazı ülkeler programları kendi dillerinde yapabilmektedir. 3) Çok Taraflı Kontroller (Multilateral Controls): Katılımcı ülkelerden, biri üye devlet olan en az iki vergi idaresinin işbirliği ile gerçekleştirilen çok taraflı kontroller, üye devletlerdeki çok uluslu şirketlerin vergi denetiminin koordine edilmesi amacını taşımaktadır. Bu faaliyetlere üye ülkelerin yanı sıra, bu tür faaliyetlere imkan veren ikili veya çok taraflı anlaşma imzalamış olan aday ülkeler katılabilmektedir. Çok taraflı kontrollere ilişkin yasal dayanaklar, KDV için, 1798/2003 sayılı Konsey Tüzüğü, doğrudan vergiler için, 2004/56/AT sayılı Konsey Direktifi ile değişikliğe uğrayan 77/799/AET sayılı Direktif, ÖTV için 2073/2004 sayılı Konsey Direktifi ve 25/01/1988 tarihli karşılıklı idari işbirliği hakkında OECD Anlaşması ve OECD model anlaşmanın 26 ncı maddesi uyarınca imzalanan ikili anlaşmalardır. Ülkemiz henüz Fiscalis kapsamında bu tür bir faaliyete katılım sağlamamıştır. 4) İletişim ve Bilgi Değişim Sistemleri: Bu başlık altında, Komisyon ve katılımcı ülkeler, CCN/CSI (Common Communications Network)/(Common Systems Interface)1, VIES (VAT Information Exchange System), EMCS (Excise Movement and Control System) gibi bilgi ve iletişim sistemlerini işlevsel hale getirmek için gerekli çalışmaları yürütmektedir. Bu sistemlerin altyapısı, KDV ve ÖTV sistemlerinin uygulanması ve özellikle idarelerin etkinliğinin sağlanması 1 CCN/CSI ağları, vergilendirme ve gümrükler alanında yetkili kurumlar arasındaki tüm işlemlerin elektronik araçlarla gerçekleştirilmesini sağlamak üzere AB tarafından geliştirilen ortak bir platformdur. 7 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı açısından büyük önem taşımaktadır. Bu sistemler, üyelikle birlikte işler hale geldiğinden, ülkemiz henüz katılım sağlamamakla birlikte, bu sistemlerin üyelikten önce kurulması gerekmektedir. 5) Eğitim Faaliyetleri: Program kapsamında, ulusal alanda çalışan kamu görevlileri için ortak eğitim sistemi oluşturulması ve üye ülkelerin birinde çalışan görevlilerin diğerlerinin eğitim faaliyetlerine katılabilmesi ve ortak araçlar geliştirilmesi ile doküman paylaşımı amaçlanmaktadır. Bu alanda ayrıca, elektronik öğrenim modülleri de geliştirilmektedir. Eğitim faaliyetleri, Fiscalis kapsamında yeni başlayan bir uygulama olup, genellikle elektronik ortamda AB müktesebatının uygulanmasına yönelik konuları içerdiğinden, ülkemizden henüz katılım sağlanmamaktadır. 6) Proje Grupları Proje grupları, belirli bir takım sonuçlara yönelik olarak, önceden belirlenmiş spesifik hedefler doğrultusunda sınırlı sayıda katılımcıdan oluşmaktadır. İlgili alanda en iyi olan ülkelerden gelen katılımcılar, belirli bir süre faaliyet göstermekte ve proje grubu süresinde çok sayıda toplantı düzenlemektedir. Proje grubu toplantıları İngilizce olarak yapılmaktadır. 7) Diğer Faaliyetler: Bunların dışında, Fiscalis yönetimine ilişkin koordinasyon toplantıları gibi faaliyetler gerçekleştirilmekte ve bu toplantılara katılımcı ülkelerin Fiscalis ekiplerinden bir temsilci davet edilmektedir. İngilizce olarak gerçekleştirilen bu faaliyetlere Ulusal Fiscalis Koordinatörlüğünü yürüten Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı katılım sağlamaktadır. 8 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı Program faaliyetleri sonucunda, - Vergilendirme ve vergi denemi alanlarında AB müktesebanın uygulanması hakkında ortak bir standardın yakalanması, - Üye ülkeler arasında etkin, verimli ve kapsamlı bir işbirliği ortamı oluşturulması, - Hem idarenin hem de mükelleflerin ihyaçlarını dikkate alan iyi uygulamaların gelişrilmesi ve yaygınlaşrılması ve - Aday ülkelerin kalım sürecinde AB müktesebana uyumu ve idari kapasitesinin gelişrilmesi için gerekli ihyaçlarının karşılanması sağlanmaktadır. Fiscalis Programı bugüne kadar katılımcı ülkelerin vergilendirme alanındaki idareleri ve kamu personeli arasında, özellikle iletişim ve bilgi değişim sistemlerini kullanmak suretiyle, işbirliğini artırarak temel amacına ulaşmıştır. Bunun yanı sıra, Fiscalis bünyesinde düzenlenen seminer, proje grubu, çalıştay, çalışma ziyareti ve çok taraflı kontrollere katılım, aynı alanda çalışan kamu personeli arasında bir ağ oluşmasına katkıda bulunmuştur. Program kapsamında en fazla faaliyet KDV ve ÖTV alanlarında gerçekleşmektedir. Doğrudan vergilendirme alanındaki faaliyetler nispeten daha az gerçekleşmiş olup, ilerleyen zamanlarda artması beklenmektedir. Sigorta primlerinin vergilendirmesi alanında ise, katılımcı ülkelerden talep gelmediği için henüz bir faaliyet düzenlenmemiştir. Fiscalis 2013 kapsamında Avrupa Komisyonu tarafından her yıl spesifik hedefler belirlenmekte ve Üye Devletlerin onayına sunulmaktadır. 2010 yılına ilişkin taslak Yıllık Çalışma Programı’nda yer alan başlıklar ve kapsadığı alanlara aşağıda yer verilmektedir. 2010 Çalışma Programının tamamı Ek-2’de yer almaktadır. Bu çerçevede 2010 yılında aşağıdaki konularda faaliyetler düzenlenmektedir: 1- Dolandırıcılıkla mücadele, gönüllü mükellef uyumu ve e-vergi dairesi stratejisi; 2- Vergi idareleri arasında idari işbirliği, çok taraflı kontroller ve İletişim ve Bilgi Değişimi Sistemleri, 3- AB müktesebatının doğru bir şekilde uygulanması, diğer ülkelerin vergi idarelerinin mevzuat ve çalışma prosedürleri hakkında bilgi edinilmesi ve konuyla ilgili uluslararası gelişmelerin takibi, 9 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı 4- Vergi mükelleflerinin tanımlanması, denetim teknikleri, risk yönetimi, vergi tahsilatı, 5- Sigorta primlerinin vergilendirilmesi alanında Üye Devletler arasında işbirliğinin geliştirilmesi, 6- Programa katılan aday ve potansiyel aday ülkelerin katılım sürecinde vergilendirme alanındaki müktesebata uyum ve idari kapasitelerinin artırılması için gerekli önlemlerin alınması, 7- Program yönetimi, ortak eğitim programları ve iletişim ve bilgi paylaşımı. II. Türkiye’nin FISCALIS Programı’na Katılımı Türkiye, katılım öncesi stratejiden yararlanan bir aday ülke olarak, Fiscalis Programı’na 2003 yılından bu yana katılmaktadır. Türkiye’nin Fiscalis 2007 Programı’na katılımına dair Mutabakat Zabtı 2003/5797 sayılı Bakanlar Kurulu Kararı ile onaylanmış ve 04.07.2003 tarih ve 25158 sayılı Resmi Gazete’de yayımlanmıştır. Fiscalis 2013 Programı’nın, önceki programla aynı nitelikte olması sebebiyle, Ülkemiz ile Avrupa Komisyonu arasında varılan mutabakat sonucunda, Fiscalis 2013 Programına da aynı koşullar altında katılım sağlanması kararlaştırılmıştır. Bu nedenle, söz konusu programa katılıma ilişkin olarak ayrıca bir Mutabakat Zaptı imzalanmamış olup, 2003 yılına ait söz konusu belge geçerliliğini korumaktadır. Fiscalis 2013 Programı, 1 Nisan 2008 itibariyle başlamıştır. Programın yürütülmesi için Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı’nda bir Fiscalis Ekibi görev yapmaktadır. Fiscalis Ekibinin başında, Fiscalis Ulusal Koordinatörü olarak belirlenen AB ve Dış İlişkiler Dairesi Başkanı yer almaktadır. Fiscalis Koordinatörü, Programın Avrupa Birliği kurallarına göre yürütülmesinden, faaliyetlerine ilgili temsilcilerin katılmasından ve bu kişilere Fiscalis bütçesinden ödeme yapılmasından, ayrıca Avrupa Komisyonuna yıllık olarak faaliyet raporu, mali rapor, çalışma ziyaretleri raporu, değerlendirme raporları ve talep edilen diğer bilgi ve belgelerin sunulmasından sorumludur. Fiscalis Programı bünyesinde düzenlenen faaliyetlere katılımın masrafları, her yıl Avrupa Komisyonu ile birlikte belirlenen ve tamamı Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı bütçesinden ödenen yıllık katkı payından karşılanmaktadır2. Fiscalis Programı kapsamında 2003 yılından bu yana düzenlenen faaliyetlere Maliye Bakanlığı’nın ilgili Birimlerinin personeli tarafından katılım sağlanmaktadır. Bugüne kadar, seminer, çalıştay, proje grubu, 2 Mutabakat Zapnda yıllık katkı payının 99.000 Avro olduğu, ancak iki taran aralarında anlaşması halinde belirlenen miktarın yarılabileceği belirlmektedir. Yarılan katkı payının %7’si idari masraf olarak Komisyon tarandan kesilmektedir. 10 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı koordinasyon toplantısı ve çalışma ziyaretlerine yaklaşık 200 temsilci katılım sağlamıştır. Türkiye ayrıca, Program bünyesinde kurulan ve 8 katılımcı ülkeden oluşan Ödeme Kaydedici Cihazlar (cash registers) proje grubunda da Maliye Bakanlığı tarafından temsil edilmiştir. Bugüne kadar katılım sağlanan faaliyetler ve katılımcı sayısı yıl bazında Şekil 1’de yer almaktadır. Şekil 1: Fiscalis Programı Faaliyetlerine Katılım Durumu (Yıllık-1 Nisan-31 Mart Dönemleri İtibariyle) Fiscalis 2013 Programı kapsamında Maliye Bakanlığı özellikle KDV, ÖTV, vergi denetimi ve e-denetim, transfer fiyatlandırma, vergi dolandırıcılığı ile mücadele, ikili anlaşmalar ve karşılıklı bilgi değişimi ve işbirliği konularında düzenlenen faaliyetlere katılım sağlamaktadır. Bu şekilde, AB’nin vergilendirme alanındaki müktesebatı ve diğer katılımcı ülkelerin uygulamaları hakkında bilgi birikimi oluşturulmaktadır. Ülkemiz ayrıca, 2008 ve 2009 yıllarında Ankara’da iki Fiscalis çalışma ziyaretine ev sahipliği yapmıştır. Çalışma ziyaretlerinin ilki 20-24 Ekim 2008 tarihlerinde gerçekleştirilmiş; çeşitli AB ülkelerinden gelen ve vergilendirme alanında çalışan 10 temsilci ülkemizdeki vergilendirme sistemi hakkında ayrıntılı olarak bilgilendirilmiştir. Söz konusu ziyaretlerin ikincisi ise 5-9 Ekim 2009 tarihlerinde gerçekleştirilmiş ve çeşitli AB ülkelerinden gelen ve vergilendirme alanında çalışan toplam 16 temsilciye geniş kapsamlı bir eğitim verilmiştir. Ankara’da gerçekleşen her iki programda da, aşağıdaki başlıklarda sunumlar yapılmış, ayrıca bir vergi dairesi ile birlikte 11 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı katılımcıların çalıştığı alanlarda Gelir İdaresi Başkanlığı’nın ilgili birimleri ziyaret edilmiştir. - Türkiye’deki temel ekonomik aktörler - Türk vergi sisteminin kurumsal ve yasal çerçevesi - Vergilendirme alanında stratejik planlama - Vergilendirme alanında karşılıklı yardım mekanizmaları - Katma Değer Vergisi, Özel Tüketim Vergisi - Kurumlar Vergisi, Transfer Fiyatlandırma, Gelir Vergisi - Vergi Denetimi, e-denetim Bu programlar ile, AB’ye üye ve aday diğer ülkelerin ülkemizdeki vergi sistemi ve uygulanması hakkında bilgi sahibi olması ve burada aynı konularda çalışan meslektaşları ile bir araya gelmek suretiyle bilgi ve deneyimlerinin paylaşılması sağlanmaktadır. Fiscalis Programı’ndan etkin bir şekilde yararlanılması, Avrupa Birliği ile yürütülen müzakere sürecinde vergilendirme faslında yürütülen çalışmaları da desteklemektedir. Fiscalis 2013 Programının başladığı 1 Nisan 2008 tarihinden bu yana katılım sağlanan faaliyetin konuları Ek1’de yer almaktadır. III. FISCALIS Faaliyetlerine Katılım ve Mali Kurallar Fiscalis Programı kapsamında düzenlenen faaliyetler, doğrudan Fiscalis koordinatörlerine bildirilmekte ve iletilen davet yazısında faaliyetin tarihi, yeri, konusu, gündemi, katılımcı profili ve sayısı ile mali kurallara ilişkin bilgiler yer almaktadır. Bu çerçevede, herhangi bir faaliyete katılımın öngörülmesi durumunda, katılımcıların isim, unvan, irtibat bilgileri ve uçuş bilgilerinin katılımcılar tarafından değil, doğrudan Fiscalis koordinatörleri tarafından ev sahibi ülkenin koordinatörüne ve Avrupa Komisyonuna iletilmesi gerekmektedir. Fiscalis 2013 Programı kapsamındaki faaliyetlere katılımın tüm masrafı (uçak bileti, otel, günlük harcırah vb.) Avrupa Birliği kuralları doğrultusunda Fiscalis bütçesinden karşılanmaktadır. Avrupa Sayıştayı ve Avrupa Komisyonu, bu hesaplar üzerinde denetim yapma yetkisine sahiptir. Aşağıda daha ayrıntılı anlatılan Fiscalis mali kuralları çerçevesinde, katılım masrafları için ulusal bütçeden bir hiçbir ödeme yapılmamaktadır. Ayrıca, katılımcıya önceden bir avans ödemesi yapılmamakta, faaliyet dönüşünde gerekli belgelerin ibrazı sonucu geri ödeme yapılmaktadır. 12 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı Fiscalis Programı çerçevesinde gerçekleştirilen faaliyetlere katılım sağlayacak olan temsilci, faaliyet dönüşünde geri ödenmek üzere, gidişdönüş ulaşım biletlerini kendi temin etmelidir. Bu çerçevede, genel ilke olarak, en uygun ve maliyet açısından en ekonomik seyahat şeklini tercih etmelidir. Faaliyet dönüşünde gerekli faturalar ibraz edildikten sonra Avrupa Birliği Fiscalis Programı kurallarına uygun olarak hazırlanmış bilgisayar programında katılım masrafı hesaplanmakta ve katılımcıya Avro cinsinden geri ödenmektedir. Faaliyete ilişkin masrafların Avro’ya çevrilmesinde Avrupa Merkez Bankası tarafından yayınlanan aylık kurların dikkate alınması zorunludur. Faaliyet sonrasında geri ödeme için gerekli belgeler (tamamı orijinal olmalıdır): Otel faturası Uçak bile faturası Uçak bile Uçak biniş kartları Havaalanına gidiş-dönüş toplu taşıma aracı biletleri (ör. Havaş vb.) Faaliyen havaalanı olmayan bir şehirde gerçekleşmesi veya birden fazla şehirde gerçekleşmesi durumunda şehirlerarası tren/otobüs biletleri Yazılı beyan (otel fiyana kahvalnın dahil olup olmadığı ve herhangi bir öğünün ev sahibi ülke tarandan ücretsiz olarak sağlanıp sağlanmadığına ilişkin) İssnai durumlarda havaalanına gidiş-dönüş taksi veya shule faturası (uçağın kalkış ve varış saatlerinin çok erken/geç olması durumu) Vize alınmasını gerekren hallerde vize için ödenen ücre gösteren makbuz/belge 13 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı Geri Ödemenin Hesaplanmasına Konu Olan Bileşenler ve Bunlara İlişkin Kurallar: Fiscalis Programı katılımcılarına yapılan geri ödeme üç unsurdan oluşmaktadır. Bunlar; günlük harcırah, seyahat masrafları ve konaklama masraflarıdır. a. Günlük Harcırah Fiscalis Programı kapsamında her ülkeye ilişkin harcırah miktarları farklıdır. Harcırah miktarı, gün bazında değil, gidişdönüş saatleri arasında geçen süreye göre otomatik olarak bilgisayarda hesaplanmaktadır. Günlük harcırah, kahvaltı, öğle yemeği, akşam yemeği, şehir içi ulaşımı ve bunun gibi diğer harcamaları kapsamaktadır. Katılımcıların, bu harcamalara ilişkin herhangi bir belge sunmaları gerekmemektedir. Otelin gecelik fiyatına kahvaltının da dahil olması veya bazı öğünlerin ev sahibi ülke tarafından ücretsiz olarak sağlanması durumunda günlük harcırahta bazı kesintiler yapılacaktır. Katılımcıların, faaliyet dönüşünde otel fiyatına kahvaltının dahil olup olmadığı ve ev sahibi ülke tarafından herhangi bir öğünün ücretsiz olarak sağlanıp sağlanmadığı konusunda Fiscalis Koordinatörü’nü bilgilendirmesi zorunludur. Bunun için katılımcının yazılı beyan formunu imzalayarak iletmesi gerekmektedir. b. Seyahat Masrafları Seyahat için en uygun ve en ekonomik ulaşım şekli tercih edilmelidir. Havayoluyla seyahat; - Uçuş süresi (tek bir uçuş için) dört saate kadar ise, olabilecek en düşük fiyatta, ekonomi sınıfında, - Uçuş süresi (tek bir uçuş için) dört saat ve daha fazla ise veya doktor tarafından belgelenen fiziksel bir ihtiyaç olması durumunda, olabilecek en düşük fiyatta, business-class’ta yapılabilmektedir. Hem kendi ülkemizde hem de seyahat edilen ülkede havaalanına gidiş-geliş için uygun ve elverişli olan her durumda toplu taşıma veya ortak ulaşım tercih edilmelidir. Bunların geri ödenmesi için bu seyahatlerin bilet veya fatura ile belgelendirilmesi gerekmektedir. Taksi ve shuttle masrafları ancak istisnai durumlarda geri 14 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı ödenmektedir. Bunun için de mutlaka makbuz ibraz edilmelidir. Şehir içi ulaşım masrafları, bir yerleşim birimi içerisindeki, (ör. otel ile etkinliğin gerçekleştirileceği yer arasındaki) ulaşıma ilişkin masraflardır. Bu masraflar, günlük harcırah kapsamında kabul edilmekte, ayrıca geri ödenmemektedir. Program aynı ülkede iki ayrı şehirde gerçekleştiriliyorsa, bu iki şehir arasındaki seyahat için de bilet üzerindeki fiyat iade edilebilmektedir. Seyahat koşullarının hafta sonunda da konaklamayı gerektirmesi halinde ilave günlük harcırah ve konaklama, en ekonomik maliyet şartının sağlanması durumunda ödenebilmektedir. Katılımcının kendi isteğiyle seyahatini uzatması durumunda, günlük harcırah hesaplamasına esas olan gidiş-dönüş saatleri en az maliyetli alternatife göre belirlenir. c. Konaklama Otel rezervasyonu, aksi belirtilmediği takdirde, katılımcı adına ev sahibi ülke tarafından yapılmaktadır. Bu çerçevede, katılımcının gidiş dönüş gün ve saatlerini başvuru esnasında doğru şekilde iletmesi önem taşımaktadır. Bazı durumlarda katılımcıların otel için ayrı bir form doldurup iletmeleri istenebilmektedir. Katılımcıya konaklama masrafları her bir ülke için belirlenmiş olan azami miktara göre geri ödenmektedir. Katılımcı, otelden ayrılırken ödemesini yapmakta, gecelik oda ücreti faaliyet dönüşü kendisine geri ödenmektedir (telefon, minibar, vs. katılımcıya aittir). Bunun için de mutlaka otel faturası ibraz edilmelidir. Bazı durumlarda, faaliyetin ilk gün öğleden sonra başlaması veya son gün öğlen bitmesi halinde, katılımcıların seyahat ve kalış sürelerini buna göre belirlemeleri istenmektedir. STRATEGIC FRAMEWORK FOR 2010 CONTEXT The aim of the Fiscalis 2013 programme is to improve the operation of the taxation systems in the internal market. As such the programme is a tool which is used to support and implement overall Community tax policy. The strategic framework of the Annual Work Programme 2010 builds on this overall Community tax policy and in particular on: • The Commission’s general objective of ensuring that tax policy supports wider EU policy goals. • The VAT strategy as outlined in the Communication from the Commission to the Council, the European Parliament and the European Economic and Social Committee reviewing and updating the VAT strategy priorities. • The coordinated strategy to improve the fight against VAT fraud in the European Union. • Recent and upcoming initiatives to further improve the Community legislative framework on administrative co-operation between Member States’ tax authorities with a view to combating tax fraud. • The main priority of the EU direct tax policy which is to address the concerns of individuals and businesses operating within the Internal Market by focusing on the elimination of tax obstacles from all forms of cross-border economic activity, as well as on the elimination of unintentional double non-taxation, in addition to continuing the fight against harmful tax competition. An increased co-ordination of tax systems is being aimed for as it would help Member States to meet these objectives. A new Commission taking office in 2010, the priorities for the Annual Work Programme might need to be adapted to take into account the priorities of the new Commission. POLICY AREAS AND RELATED PRIORITIES FOR 2010 The strategic framework of the Annual Work Programme is structured according to the overall objective and specific objectives (Article 4 of the Programme Decision) for the different areas falling within its scope, being VAT and excise duties, direct taxation, taxes on insurance premiums and for candidate and potential candidate countries. Improve the proper functioning of the taxation systems in the internal market Overall objective of Article 4 §1 of the F2013 Decision 1.1. Fight against fraud • Provide general support for the fight against fraud. • Provide the framework for discussions on anti-fraud issues, including co-ordination of researches, exchange of views on systematic fraud developments and trends and the enhancement and improve common measures to counter fraud. 1.2. Voluntary compliance and easing the burden on businesses • Support voluntary compliance through the exchange of best practices and of new approaches. • Reduce administrative burden through the simplification and modernisation of tax obligations with simultaneous consideration of anti-fraud issues. 1.3. An e-tax administration strategy • Support the development of an e-administration strategy within the participating countries by continuing the ongoing developments in the field of e-administration. 2. Information exchange and administrative co-operation among Member States Objectives 2 (a) i and 2 (b) i (part 1 of sentence) of Article 4 of the F2013 Decision 22 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı 2.1. Administrative co-operation arrangements between tax administrations • Support the development and enhancement of mechanisms of administrative co-operation, through joint approaches and exchange of best practices, in particular with a view to evaluating the effectiveness of Community legislation on direct and indirect taxation. • Stimulate feedback, monitoring and the exchange of best practices to improve the quality of data exchanged and the speed of the exchanges. • Support the network of liaison officers for administrative cooperation through common activities dealing with practical issues. • Support the automatic exchange of information in the field of information and use of standard forms for the purposes of administrative co-operation in the field of direct taxation. • Exchange experience on the implementation of various tools under Regulation 1798/2003/EC, Regulation 2073/2004/ EC and Directive 77/799/EEC: presence of tax officials in the other Participating Countries' tax administrations, participation in administrative inquiries in other Participating Countries, consultation between competent authorities. • Support discussions on the use of the data exchanged between Member States about Intra-Community transactions, which from 1/1/2010 will be exchanged on a monthly basis. • Support the exchange of information in the field of excise duties (in particular exchange of information upon request and spontaneous exchange of information). 2.2. Multilateral controls • Enhance the organisation and improve the conduct of multilateral controls covering VAT, excise duties and direct tax. • Support the planning and management of the Multilateral Controls in order to increase the quality and processing time of the MLC’s. • Strive for a larger use of Multilateral Controls, especially in terms of more participating countries making use of and initiating MLC’s. • Pay attention to providing support to the communication needs in 23 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı relation to multilateral controls by setting up new communication structures in this area. 2.3. Communication and Information Exchange Systems • Ensure operation, provide support and provide the corrective and evolutive maintenance for the existing systems: o Common Communications Network/Common System’s Interface (CCN/CSI) o VAT Information Exchange System (VIES), VAT on e-Services (VoeS) and VIES on-the-Web o The VAT refund & place of supply services trans European systems, under the umbrella of the VAT package o Excise systems such as SEED, SEED on Europa, EWSE and MVS o The Excise Movement and Control System (EMCS), including CS/MIS (Monitoring & Statistics), TA (Test Application) o The Taxation of Savings System (ToS). • Develop common forms for the administrative co-operation in the field of VAT, direct taxes and recovery of claims. • Develop the TIN on-the-Web TIN checking system and investigate the possible development of computer assisted country profiles for administrative cooperation in direct taxation • Provide IT support for the regionalisation of the VAT administrative cooperation, allowing regional and local units to exchange information directly and in a secured way. • Support the development of new Communication and Information Exchange systems in support of new Community legislation in the field of indirect taxation or direct taxation when it will be adopted or in view of its adoption (cf.2.1), and in particular the mini one stop shop trans European electronic system under the umbrella of the VAT package. • Assess the implementation of the electronic system for the VAT refund and place of supply of services and facilitate the sharing of best practices. • Support the management of IT services supply (Tool for Automated Supply MANagement – TASMAN) and the use of standards and best practices for development and deployment of trans-European IT systems (Quality Assurance (QA) and TAXUD Electronic Management for Projects Online (TEMPO)). 24 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı 3. A consistent implementation framework of Community legislation • Support a consistent implementation framework of existing Community VAT, Excise duties and direct tax legislation. • Gain a better understanding of tax anti-avoidance controls across the EU with a view to seeking consistency; close down opportunities for tax advisers to use “arbitrage” (i.e. avoid tax payment by using different interpretations of EU legislation), differentiation of the understanding of tax evasion and tax avoidance. • Share between tax administrations the understanding of judgements of the ECJ on VAT, excise duties (including passenger car taxation), and direct taxation cases aimed at facilitating a consistent understanding of their consequences. • Improve EC Law knowledge and facilitate the interpretation of ECJ cases by administrative judges in charge of direct taxation. • Support a consistent implementation framework of new Community VAT, Excise duties and direct tax legislation when it will be adopted by the Community legislator or in view of its adoption. • Gather input for the improvement of the Merger Directive (Directive 90/434/EEC) and its functioning. • Improve knowledge on triangular and chain transactions. • Ensure consistency and coherence between the customs and tax procedures under Community legislation, as well as their implementation, notably to take account of the most recent customs developments (Modernised Customs Code). 3.2. Participating countries’ knowledge of other tax administrations’ legislation and working procedures • Improve the participating countries’ knowledge of other tax administrations’ direct and indirect taxation legislation and working procedures. • Examine the possibilities, best practices and practical methods to apply differentiated car taxes based on CO2 emissions of 25 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı individual passenger cars, which would both ensure stability of revenue generation and promote sustainability. • Exchange experience and know how in the area of environmental taxation and energy taxation in particular. • Exchange experience and know how in the area of tobacco taxation, in particular as an instrument for tobacco control. • Ensure the development, operation, maintenance and improvement of Communication and Information Exchange Systems, which cover all areas of taxation, i.e. VAT, excise duties and direct taxation, and which provide comparable information on tax levels and developments in taxation and tax policies in the EU Member States, such as the Taxes in Europe Database and the EU Taxation Trends Database. Support the participating countries both in terms of maintenance and operation as well as ensuring technical assistance for the update of the content. 3.3. International developments relevant for Community law • Improve participating countries’ knowledge and awareness of international developments that are relevant to Community law in the direct and indirect taxation field, in particular developments at OECD level and in relation to Tax Treaties. • Facilitate a common understanding of transfer pricing principles. 4. The sharing, development and dissemination of good administrative practice Objectives 2 (a) iii and (b) i (part 2 of sentence) of Article 4 of the F2013 Decision 4.1. Identification of tax payers • Share knowledge of best practice on the identification of taxpayers. 4.2. Audit techniques • Exchange experience in the area of non-conventional ways of control. • In the field of alcohol excise duties, exchange expertise on the effectiveness of existing “denaturants” with the objective of establishing best practice and exploring the feasibility of Community agreed denaturants that would reinforce the fight against alcohol fraud. 26 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı • Develop and stimulate the use of new audit technologies by tax administrations and in particular build on the ongoing developments in the field of e-auditing. 4.3. Risk management • Develop and methodologies. improve common risk management 4.4. Tax Collection and Enforcement • Support the use and functioning of the consolidated Recovery Directive 2008/55/EC of 26 May 2008 by providing support concerning the understanding and implementation of its provisions. • Provide support concerning the improvement of administrative procedures in relation to the consolidated Recovery Directive and the implementing measures, in particular through the development of automatic translated forms and of a uniform instrument permitting enforcement and a uniform instrument for notification. • Support the exchange of experience in the use of Council Regulation EC/1346/2000 on insolvency (bankruptcy and restructuring) proceedings for the purpose of tax recovery. • Support the exchange of experience used in the assets determination procedure. • To exchange know how and experiences on the efficiency of preventive measures. 5. Co-operation between Member States related to taxes on insurance premiums Objective 2 (c) of Article 4 of the F2013 Decision • Improve co-operation between Member States ensuring a better application of the existing rules in relation to taxes on insurance premiums. • Support the recovery rules and mutual assistance arrangements in a similar way as is being undertaken for VAT and excise duties. 6. Meet the special needs of Candidate Countries Objective 2 (d) of Article 4 of the F2013 Decision 27 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı • Meet the special needs of Candidate and potential Candidate Countries so that they take the necessary measures for accession in the field of tax legislation and administrative capacity. 7. Horizontal programme issues 7.1. Management of the Fiscalis 2013 programme • Support and improve the management of the Fiscalis programme. • Improve the steering and co-ordination of programme activities. • Ensure the efficient use of programme management instruments such as those to manage the budget and activities (Activity Reporting Tool (ART)). Ensure a smooth roll out and implementation of the reviewed ART (ART 2010), including the training of end users. • Work on a common and appropriate use of programme tools. • Implement the recommendations of the final evaluation of Fiscalis 2007. Prepare the mid term evaluation of Fiscalis 2013 which shall review the results obtained in terms of effectiveness and efficiency, the continued relevance of the initial objectives of the programme and impact of its activities as well as assess the use of funding, the progress of follow-up and implementation. • Prepare for a successor Fiscalis programme by assessing the needs and identifying options. 7.2. Common training Article10 of the F2013 Decision • Provide a common core of tax training courses and e-learning modules for officials and – if appropriate – for other stakeholders so as to enable them to acquire the necessary common professional skills and knowledge, in particular in the areas of VAT fraud and Administrative co-operation, or other identified, operational topics of tax policy priority, arising from Participating Countries’ needs. Enhance the efficiency of localisation processes for EU e learning courses and work towards the establishment of an efficient maintenance and up-dating concept for EU e learning courses. • Update the e-learning course on the VAT directive in line with upcoming legislative modifications in 2010. 28 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı • Prepare and possibly establish the necessary e-environment for common training management, in particular through the creation of a common platform for cross-border online collaboration in the field of training, (e.g. Training Who’s who online project and Training e-catalogue). Analyse the potential of Common Training Expertise Centres in cooperation with the national tax training administrations. 7.3. Communication and information sharing Article 12 of the F2013 Decision • Improve the communication and information sharing within the programme sphere, especially on programme outputs. Launch a common platform allowing online collaboration as a modern and efficient way to strengthen co-operation between the national tax administrations and to maximise the benefits and impacts arising from Fiscalis 2013 activities and their outputs. Develop information sharing best practices by building upon the experiences of the 2009 pilots. • Set up common communication initiatives on Community legislation or new policy initiatives and for awareness raising and image building of the national tax administrations towards the population in general and for particular target audiences. • Align and implement the future communication needs on Community legislation or new policy initiatives with the support of the EU Communication Network for taxation and customs (ECNtc). Support and improve the functioning of the ECNtc through the implementation of the recommendations of the 2009 Rome Workshop. B. Selection criteria for individual activities Activities carried out under the programme will be authorised by the Authorising Officer provided that the following conditions are fulfilled: o All activities carried out under the programme in 2010 aim for and contribute to the realisation of the above-mentioned strategic framework. o Each activity is proposed by a Participating Country administration or by a Commission service by means of a duly filled in Proposal Form mentioning in particular objectives and expected outcome. o The envisaged activity is one of the activities provided for by Articles 6 to 10 of the programme decision (communication and 29 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı information exchange systems, multilateral controls, seminars, project groups, working visits and training activities and any other activity required for the realisation of the programme objectives). The activities, except for the communication and information exchange systems, are called “joint actions”. o The envisaged activity will have to comply with EU data protection legislation whenever it entails the processing of personal data. C. Framework for budgetary implementation and financial management The total indicative amount for the Fiscalis budget for 2010 is 24.000.000 EUR. The operations are divided into the following categories: o IT actions: total amount foreseen: 17.400.000 EUR. o Joint actions: total amount foreseen: 6.000.000 EUR. o Training: 600.000 EUR o IT actions relate to the operation, support, improvement and development of communication and information exchange systems in the tax field by means of the equipment and service procurement contracts necessary to ensure that the connection of national networks is operational. o Joint actions are multilateral controls, seminars, project groups, working visits and any other activity carried out by national administrations or the Commission, the costs of which will be borne by the Community. The financial contributions paid by Croatia, FYROM, Turkey and Serbia will be added to this amount for joint actions. o Common Training tools: the development and maintenance of training modules and where appropriate, the supply of the necessary tools for common e-learning in the field of taxation. o The financial allocation for the programme may also cover expenses relating to programme management activities, i.e. preparatory, monitoring, control, audit and evaluation activities in particular studies, meetings, information and publication actions, expenses linked to IT networks focusing on information exchange, together with all other technical and administrative expense that the Commission may incur for the management of the programme. The Commission shall, further to Article 14(3) of the programme 30 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı decision and in accordance with the Financial Regulation, determine the rules relating to the payment of expenses and shall communicate them to participating countries. Further to this provision, the Financial Guide will be sent by the Director General of TAXUD to the Participating Countries. The main rules are: o The budget allocated to joint actions will finance the participation of national officials in these activities by covering their travel, hotel and daily allowance costs. o In conformity with the rule of subsidiarity, Participating Countries receive a proportion of the amount allocated to joint actions at their disposal for the direct reimbursement of their officials taking part in programme activities. o The proportion for each participating country is dependant on the number of programmed activities and the absorption capacity of the national administrations in terms of human resources. o Participating Countries are submitted to a control ex post and submit by means of ART a Financial Report detailing the expenditure made. 31 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı EK-3: Fiscalis 2013 Programı Kararı Decision No 1482/2007/EC of the European Parliament and of the Council of 11 December 2007 establishing a Community programme to improve the operation of taxation systems in the internal market (Fiscalis 2013) and repealing Decision No 2235/2002/EC Official Journal L 330, 15/12/2007 P. 0001 - 0007 THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof, Having regard to the proposal from the Commission, Having regard to the opinion of the European Economic and Social Committee [1], Acting in accordance with the procedure laid down in Article 251 of the Treaty [2], Whereas: (1) Decision No 888/98/EC of the European Parliament and of the Council of 30 March 1998 establishing a programme of Community action to ameliorate the indirect taxation systems of the internal market (Fiscalis programme) [3] (hereinafter referred to as “the 2002 programme”) and Decision No 2235/2002/EC of the European Parliament and of the Council of 3 December 2002 adopting a Community programme to improve the operation of taxation systems in the internal market (Fiscalis programme 2003-2007) [4] (hereinafter referred to as “the 2007 programme”) have significantly contributed to the achievement of the objectives of the Treaty. It is therefore appropriate to continue the activities commenced under those programmes. The programme established by this Decision (hereinafter referred to as “the Programme”) should run for a period of six years to align its duration with that of the multiannual financial framework contained in the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management [5]. (2) In the internal market, the effective, uniform and efficient application of Community law is essential for the functioning of taxation systems, in particular for the protection of national financial interests by combating tax evasion and tax avoidance, avoiding distortions of competition and reducing burdens on administrations and taxpayers. Achieving such an effective, uniform and efficient application of Community law is a matter for the Community, acting in partnership with 32 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı the Member States. Efficient and effective cooperation among current and possible future Member States and between them and the Commission is a key element for the functioning of the taxation systems and the fight against fraud. The Programme should also help to identify legislation and administrative practices which may hamper cooperation and possible remedies for obstacles to such cooperation. (3) In order to support the process of accession by candidate countries, practical means should be provided in order to enable the tax administrations of those countries to undertake the full range of tasks required under Community legislation as of the date of their accession. The Programme should therefore be open to candidate countries. A similar approach should be taken to potential candidate countries. (4) The trans-European computerised secure communication and information exchange systems financed under the 2007 programme play a vital role in reinforcing the taxation systems within the Community and should therefore continue to be financed. In addition, it should be possible to include in the Programme further tax related information exchange systems such as the Excise Movement Control System (EMCS) established by Decision No 1152/2003/EC of the European Parliament and of the Council of 16 June 2003 on computerising the movement and surveillance of excisable products [6] and any system required for the purposes of Council Directive 2003/48/EC of 3 June 2003 on taxation of savings income in the form of interest payments [7]. (5) Experience gained by the Community from the 2002 and 2007 programmes shows that bringing officials from different national administrations together in professional activities, such as working visits, seminars, project groups and multilateral controls, contributes to the achievement of the objectives of such programmes. Those activities should therefore be continued. It should remain possible to develop new types of activities to respond even more effectively to the needs that may arise. (6) Experience gained from the 2002 and 2007 programmes indicates that the coordinated development and implementation of a common training programme contribute significantly to the objectives of such programmes, in particular in achieving a high standard of understanding of Community law. The opportunities offered by an electronic learning environment should be fully explored in this context. (7) Officials active in the field of taxation need a sufficient standard of linguistic competence to cooperate and participate in the Programme. It should be the responsibility of the participating countries to provide the necessary language training for their officials. 33 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı (8) It is appropriate to provide for the possibility to organise certain activities with the participation of experts, such as officials, of third countries or representatives of international organisations. (9) The mid-term evaluation of the 2007 programme has confirmed that information resulting from programme activities should be made available to all participating countries and the Commission. (10) Although the primary responsibility for achieving the objectives of the Programme lies with the participating countries, Community action is needed for the coordination of the activities pursued under the Programme as well as for the provision of the infrastructure and the necessary stimulus. (11) Since the objectives of this Decision cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in that Article, this Decision does not go beyond what is necessary in order to achieve those objectives. (12) This Decision lays down, for the entire duration of the Programme, a financial envelope constituting the prime reference, within the meaning of point 37 of the Interinstitutional Agreement of 17 May 2006 on budgetary discipline and sound financial management, for the budgetary authority during the annual budgetary procedure. (13) The measures necessary for the implementation of this Decision should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission [8], HAVE ADOPTED THIS DECISION: CHAPTER I GENERAL PROVISIONS Article 1 Fiscalis 2013 programme 1. A multiannual Community action programme (Fiscalis 2013) (hereinafter referred to as the “Programme”), is hereby established for the period from 1 January 2008 to 31 December 2013 to improve the operation of the taxation systems in the internal market. 34 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı 2. The Programme shall consist of the following activities: (a) communication and information-exchange systems; (b) multilateral controls as defined in Article 2(4); (c) seminars and project groups; (d) working visits; (e) training activities; and (f) other similar activities required to achieve the objectives of the Programme. Participation in activities referred to in points (b) to (f) shall be on a voluntary basis. Article 2 Definitions For the purposes of this Decision the following definitions shall apply: 1. “taxation” shall mean the following taxes applied in the participating countries, as defined in Article 3(1): (a) value added tax; (b) excise duties on alcohol and tobacco products, as well as taxes on energy products and electricity, as provided for in Directives 92/83/ EEC [9], 95/59/EC [10] and 2003/96/EC [11], respectively; (c) taxes on income and on capital as described in Article 1(2) of Directive 77/799/EEC [12]; (d) taxes on insurance premiums as defined in Article 3 of Directive 76/308/EEC [13]; 2. “administration” shall mean the public authorities and other bodies in the participating countries which are responsible for administering taxation or tax-related activities; 3. “official” shall mean a member of an administration; 4. “multilateral control” shall mean the coordinated control of the tax liability of one or more related taxable persons organised by two or more participating countries with common or complementary interests, which include at least one Member State. Article 3 Participation in the Programme 35 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı 1. Participating countries are the Member States and the countries referred to in paragraph 2. 2. The Programme shall be open to the participation of the following: (a) candidate countries benefiting from a pre-accession strategy, in accordance with the general principles and general terms and conditions for the participation of those countries in Community programmes established in the relevant framework agreement and association council decisions; and (b) potential candidate countries, in accordance with provisions to be determined with those countries following the establishment of framework agreements concerning their participation in Community programmes. 3. Participating countries shall be represented by officials. Article 4 Objectives 1. The overall objective of the Programme shall be to improve the proper functioning of the taxation systems in the internal market by increasing cooperation between participating countries, their administrations and officials. 2. The specific objectives of the Programme shall be the following: (a) in respect of value added tax and excise duties: (i) to secure efficient, effective and extensive information exchange and administrative cooperation; (ii) to enable officials to achieve a high standard of understanding of Community law and its implementation in Member States; and (iii) to ensure the continuing improvement of administrative procedures to take account of the needs of administrations and taxable persons through the development and dissemination of good administrative practice; (b) in respect of taxes on income and on capital: (i) to secure efficient and effective information exchange and administrative cooperation, including the sharing of good administrative practices; and (ii) to enable officials to achieve a high standard of understanding of Community law and of its implementation in Member States; 36 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı (c) in respect of taxes on insurance premiums, to improve cooperation between administrations, ensuring better application of the existing rules; and (d) in respect of candidate and potential candidate countries, to meet the special needs of those countries so that they take the necessary measures for accession in the field of tax legislation and administrative capacity. Article 5 Work programme and indicators The Commission shall, in accordance with the management procedure referred to in Article 17(2), establish a work programme annually. The work programme shall be based on a schedule of activities envisaged for the budgetary year concerned and the expected breakdown of the funds. The work programme shall be published on the Commission’s website. The work programme shall contain indicators for the specific objectives of the Programme set out in Article 4(2), which shall be used for the mid-term and final evaluations of the Programme in accordance with Article 19. CHAPTER II PROGRAMME ACTIVITIES Article 6 Communication and information exchange systems 1. The Commission and the Member States shall ensure that the communication and information exchange systems referred to in paragraph 2 are operational. 2. The communication and information exchange systems shall comprise the following: (a) the Common Communications Network/Common Systems Interface (CCN/CSI); (b) the VAT Information Exchange System (VIES); (c) excise systems; (d) the Excise Movement and Control System (EMCS); and (e) any new tax-related communication and information exchange systems, established under Community legislation and provided for in the 37 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı work programme referred to in Article 5. 3. The Community components of the communication and information exchange systems shall be the hardware, software and network connections which are common to all Member States. The Commission shall, on behalf of the Community, conclude the necessary contracts to ensure the operational nature of those components. 4. The non-Community components of the communication and information exchange systems shall comprise the national databases forming part of those systems, the network connections between the Community and non-Community components and such software and hardware as each Member State deems appropriate for the full operation of those systems throughout its administration. The Member States shall ensure that the non-Community components are kept operational and are interoperable with the Community components. 5. The Commission shall coordinate, in cooperation with the Member States, those aspects of the establishment and functioning of the Community and non-Community components of the systems and infrastructure referred to in paragraph 2 which are necessary to ensure their operability, interconnectivity and continuous improvement. The Member States shall comply with the schedules and deadlines established for that purpose. Article 7 Multilateral controls Participating countries shall choose from among the multilateral controls organised by them those the costs of which are to be borne by the Community in accordance with Article 14. After each such control, an evaluation report shall be submitted to the Commission. Article 8 Seminars and project groups The Commission and the participating countries shall together organise seminars and project groups. Article 9 Working visits 1. Participating countries may organise working visits for officials. The working visits shall not exceed one month. Each working visit shall 38 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı target a particular professional activity and shall be sufficiently prepared, monitored and subsequently evaluated by the officials and administrations concerned. 2. Participating countries shall enable visiting officials to play an effective role in the activities of the host administration. To this end, visiting officials shall be authorised to carry out the tasks relating to the duties entrusted to them by the host administration in accordance with its legal system. 3. During the working visit, the civil liability of the visiting official in the performance of his duties shall be treated in the same way as that of officials of the host administration. Visiting officials shall be bound by the same rules of professional secrecy and transparency as officials of the host administration. Article 10 Training activities 1. Participating countries, in cooperation with the Commission, shall facilitate structured cooperation between national training bodies and officials responsible for training in taxation administrations, and in particular by the following means: (a) the development of existing training programmes and, where necessary, new programmes to provide a common core of training for officials so as to enable them to acquire the necessary professional skills and knowledge; (b) where appropriate, the opening of training courses in the field of taxation to officials from all participating countries, where such courses are provided by a participating country for its own officials; (c) where appropriate, the development of the necessary tools for common tax training. 2. Participating countries shall, where appropriate, integrate the jointly developed training programmes referred to in paragraph 1(a) into their national training programmes. Participating countries shall ensure that their officials receive the initial and continuous training necessary to acquire common professional skills and knowledge in accordance with the training programmes and the linguistic training necessary for officials to attain a sufficient level of linguistic competence for participation in the Programme. Article 11 Participation in activities under the Programme 39 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı Experts, such as representatives of international organisations and officials of third countries, may take part in activities organised under the Programme whenever that is essential to achieve the objectives set out in Article 4. Article 12 Information sharing Information resulting from the activities referred to in Article 1(2) shall be shared between participating countries and the Commission insofar as it contributes to the achievement of the Programme’s objectives. CHAPTER III FINANCIAL PROVISIONS Article 13 Financial framework 1. The financial envelope for the implementation of the Programme for the period from 1 January 2008 to 31 December 2013 shall be EUR 156900000. 2. Annual appropriations shall be authorised by the budgetary authority within the limits of the multiannual financial framework, in accordance with point 37 of the Interinstitutional Agreement of 17 May 2006 on budgetary discipline and sound financial management. Article 14 Expenditure 1. The expenditure necessary for the implementation of the Programme shall be borne by the Community and the participating countries in accordance with paragraphs 2 to 6. 2. The Community shall bear the following expenditure: (a) the costs of the acquisition, development, installation, maintenance and day-to-day operation of the Community components of the communication and information exchange systems referred to in Article 6(3); (b) the travel and living expenses incurred by officials from the participating countries relating to multilateral controls, working visits, seminars and project groups; (c) the organisational costs of seminars; 40 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı (d) the travel and living expenses incurred by experts participating in activities as referred to in Article 11; (e) the costs of the acquisition, development, installation, maintenance of training systems and modules insofar as they are common to all participating countries; and (f) the costs of other activities referred to in Article 1(2)(f), up to a maximum of 5 % of the overall cost of the Programme. 3. The participating countries shall cooperate with the Commission to ensure that appropriations are used in accordance with the principle of sound financial management. The Commission shall, in accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities [14] (hereinafter referred to as “the Financial Regulation”), determine the rules relating to the payment of expenses and shall communicate them to the participating countries. 4. The Commission shall, in accordance with the management procedure referred to in Article 17(2), adopt any necessary measures for the budget management of the Programme. 5. The financial allocation for the Programme may also cover expenses relating to preparatory, monitoring, control, audit and evaluation activities which are required directly for the management of the Programme and the achievement of its objectives, and in particular, studies, meetings, information and publication actions, expenses linked to IT networks focusing on information exchange, together with all other technical and administrative assistance expenses that the Commission may incur for the management of the Programme. The share of administrative expenditure shall, in general, not exceed 5 % of the overall cost of the Programme, including administrative expenditure attributed to the Commission. 6. The participating countries shall bear the following expenditure: (a) the costs of the acquisition, development, installation, maintenance and day-to-day operation of the non-Community components of the communication and information exchange systems referred to in Article 6(4); and (b) the costs relating to the initial and continuing training, including linguistic training, of their officials. 41 Maliye Bakanlığı Avrupa Birliği ve Dış İlişkiler Dairesi Başkanlığı Article 15 Applicability of the Financial Regulation The Financial Regulation shall apply to all grants within the meaning of Articles 108 to 120 thereof which are awarded pursuant to this Decision. In particular, a prior written agreement, within the meaning of Article 108 of the Financial Regulation and its detailed implementing provisions, shall be concluded with the beneficiaries, who shall state their agreement to audits by the Court of Auditors into the use made of the financing granted. Such audits may be carried out without prior notice. Article 16 Financial control Financing decisions and any agreements or contracts resulting from this Decision shall be subject to financial control and, if necessary, on-the-spot audits by the Commission, in particular the European AntiFraud Office (OLAF), and by the Court of Auditors. CHAPTER IV OTHER PROVISIONS Article 17 Committee 1. The Commission shall be assisted by the Fiscalis Committee. 2. Where reference is made to this paragraph, Articles 4 and 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof. The period laid down in Article 4(3) of Decision 1999/468/EC shall be set at three months. Article 18 Follow-up The Programme shall be subject to continuous joint monitoring by the participating countries and the Commission. Article 19 Mid-term and final evaluations 1. Mid-term and final evaluations of the Programme shall be carried out under the responsibility of the Commission using the reports referred to in paragraph 2 and any other relevant information. The Programme 42 Avrupa Birliği’nin Vergilendirme Alanındaki Fiscalis Programı Ve Türkiye’nin Kalımı shall be evaluated in terms of the objectives set out in Article 4. The mid-term evaluation shall review the results obtained at the mid-term of the duration of the Programme in terms of effectiveness and efficiency, as well as the continued relevance of the objectives of the Programme and impact of its activities. It shall also assess the use of funding and the progress of follow-up and implementation. The final evaluation shall concentrate on the effectiveness and efficiency of the activities of the Programme. The mid-term and final evaluations shall be published on the Commission’s website. 2. The participating countries shall submit the following evaluation reports to the Commission: (a) by 31 March 2011, a mid-term evaluation report on the Programme’s relevance, effectiveness and efficiency; and (b) by 31 March 2014, a final evaluation report focusing on the Programme’s effectiveness and efficiency. 3. On the basis of the reports referred to in paragraph 2 and any other relevant information, the Commission shall submit to the European Parliament and to the Council the following reports: (a) by 31 July 2011, a mid-term evaluation report and a communication on the desirability of continuing the Programme, accompanied, where appropriate, by a proposal; and (b) by 31 July 2014, the final evaluation report. Those reports shall also be sent to the European Economic and Social Committee and the Committee of the Regions for their information. Article 20 Repeal Decision No 2235/2002/EC shall be repealed with effect from 1 January 2008. However, financial obligations related to actions pursued under that Decision shall continue to be governed by that Decision until their completion. Article 21 Entry into force This Decision shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
