Gösterilere Katılmaları Sebebi ile Terör Suçlusu Sayılan Çocuklar Hakkında Saha Ziyareti Raporu Gösterilere Katılmaları Sebebi ile Terör Suçlusu Sayılan Çocuklar Hakkında Saha Ziyareti Raporu GİRİŞ [3] Bu rapor, çocukların bazı gösterilere katılmaları ile ilgili olarak yargılanmaları ve cezaya maruz kalmaları nedeniyle, sorunun nedenleri ve çözüm önerilerini saptamak üzere 9-11 Mart 2009 tarihlerinde Adana ve Diyarbakır, 23-24 Mart tarihlerinde Hakkari illerinde yapılan saha ziyaretleri sonrasında hazırlanmıştır. Çalışma ziyaretleri, UNICEF Türkiye Temsilciliği ve Başbakanlık İnsan Hakları Başkanlığı işbirliğinde gerçekleştirilmiş, gidilen illerde kamu kurumları ve sivil toplum kuruluşlarının yetkilileri ile görüşülmüştür. Raporun ilk bölümünde konunun geri planı açıklanmaya çalışılmış, ikinci bölümünde ise sorunlar ve çözüm önerileri ortaya konulmuştur. 1. KISIM ............................................................................................. [1] Genel Bakış Çocukların gösterilere katılmalarının bir sorun olarak görülmeye başlanması ve gösterilere katılan çocukların tâbi olacakları yasal düzenlemelerin belirlenmesinde 2006 yılında Diyarbakır’da gerçekleştirilen gösteriler önemli bir yer tutmaktadır. 28 Mart 2006 günü Diyarbakır’da, PKK’ya mensup olduğu iddia edilen ve Muş’ta öldürülmüş olan 4 kişinin cenaze törenleri sırasında başlayan gösteriler 29 Mart günü de devam etmiş ve gösteriler sırasında 6’sı 18 yaşının altında 10 kişi hayatını kaybetmiştir.1 Başbakan Sayın Recep Tayip Erdoğan 1 Nisan 2006 tarihinde olaylarla ilgili olarak bir açıklama yaparak, şunları söylemiştir: “Annelere babalara sesleniyorum. Çocuklarını sokaklara dökenler, terör örgütleri tarafından kullanılmasına fırsat verenler, yarın ağlamanız boş yere olacak. Güvenlik güçlerimiz çocuk da olsa, kadın da olsa kim olursa olsun eğer terörün maşası haline gelmişse, gerekli müdahale ne ise bunu yapacak. Hiçbir demokrasi standardı bu tür şiddet olaylarına müsaade etmez.”2 1 Barolar Çocuk Hakları Komisyonları 28.3.2006 Tarihlerinde Diyarbakır’da Gerçekleşen Gösteriler Hakkında Çocuk Merkezli İnceleme Ve Tespitlere İlişkin Rapor 2 Radikal Gazetesi 1.4.2006 http://www.radikal.com.tr/haber.php?haberno=183107 [5] Bu olayları takip eden günlerde, çocukların özel yetkili ağır ceza mahkemelerinde yargılanmalarını sağlamak üzere Terörle Mücadele Kanunu’nda değişiklik yapılmasını öngören bir Kanun Tasarısı Türkiye Büyük Millet Meclisi gündemine getirilmiş ve Tasarı 29.6.2006 tarihinde kabul edilerek, yürürlüğe girmiştir. 2006 yılında Türkiye’de 27 ilde 18 yaşının altında 295’i erkek, 9’u kız, 304 çocuk “terör suçları”3 sebebiyle gözaltına alınmıştır.4 Bu gözaltına alma işlemlerinden, 13 tanesi Adana’da, 198 tanesi ise Diyarbakır’da gerçekleşmiştir.5 2007 ve 2008 istatistikleri henüz yayınlanmamıştır. Aynı yıl içerisinde “terör suçları”6 kapsamında 18 yaşından [6] küçük 719 çocuk hakkında özel yetkili ağır ceza mahkemelerinde dava açılmıştır. 2007 yılında ise bu sayı Türkiye genelinde 869’a yükselmiştir.7 3 Güvenlik Birimlerine Gelen Getirilen Çocuk İstatistikleri’nde yasa dışı gösterilere katılmak bazen 2911 sayılı Toplantı ve Gösteri Yürüyüşleri Hakkında Kanuna muhalefet, bazen de TCK 220 ve 314. maddelerinin ihlali anlamında terör suçu olarak sınıflandırılmaktadır. Güvenlik Birimlerine Gelen Getirilen Çocuk İstatistiklerinde 2911 sayılı Kanuna muhalefet hiç yer almamaktadır. Türk Ceza Kanunu’nda düzenlenen suç tipleri ise yasal tanımları ya da madde numaraları ile değil, güvenlik birimlerinin yapmış olduğu sınıflandırmaya göre yer almaktadır. Bu nedenle burada sadece güvenlik birimlerince terör suçu olarak sınıflandırılmış eylemler dolayısıyla gözaltına alınmış çocuk sayıları yer almaktadır. 4 Güvenlik Birimlerine Gelen Getirilen Çocuk İstatistikleri – 2006 TUİK 5 Bu istatistikler 27 ili kapsamakta ve Hakkari ili bunlar içerisinde yer almamaktadır. 6 Bu sayıların yer aldığı kaynakta “terör suçları”; Terörle Mücadele Kanunu’na muhalefet suçları, TCK 301, 220 ve 314. maddeleri kapsamındaki eylemleri içerecek biçimde kullanılmaktadır. 7 Adalet Bakanı Mehmet Ali Şahin tarafından bir soru önergesine verilen 06.02.2009 tarihli yanıt. 2006 – 2008 arasında gerçekleştirilen çok sayıda gösterilerden biri Şırnak’ın Cizre İlçesi’nde 15 Şubat 2008’de gerçekleşmiş ve gösteride 15 yaşındaki Yahya Menekşe isimli bir çocuğun polis panzeri tarafından ezilerek hayatını kaybettiği iddia edilmiştir. Son olarak, 2009 yılında Nisan ayında Hakkari’de gösteriler sırasında 14 yaşındaki S.T.’nin polis tarafından beyin kanaması tehlikesi oluşturacak biçimde dövüldüğü, 14 yaşındaki Abdulsamet Erip’in dereye düşerek hayatını kaybettiği, 8 yaşındaki Maziye Aslan’ın ise Van’da polis panzeri altında kalarak hayatını kaybettiği iddia olunmuştur. 2006 yılından bu yana özellikle 21 Mart Nevruz Bayramı, 15 Şubat Abdullah Öcalan’ın yakalanmasının yıl dönümü gibi belirli günlerde veya çeşitli basın açıklamaları ve mitingler sonrasında çok sayıda çocuğun gözaltına alınmalarına, tutuklanmalarına ve hapis cezasına mahkum edilmelerine tanık olunmaktadır. Bu süreçte zarar gören çocukların durumu hakkında duyarlılık yaratmak ve kanun değişikliği konusunda bir kamuoyu oluşturmak üzere çeşitli sivil toplum kuruluşlarınca çalışmalar yürütülmektedir. İnsan hakları alanında çalışan sivil toplum kuruluşları davaları izlemekte ve raporlandırmaktadır. Ayrıca, pek çok sivil toplum kuruluşunun katılımı ile Çocuklar İçin Adalet Girişimi oluşturulmuştur.8 8 Çocuklar İçin Adalet Girişimi’ni oluşturan kuruluşlar: Ankara Barosu Çocuk Hakları Merkezi, Başak Kültür ve Sanat Vakfı, Çocuklar Aynı Çatı Altında Derneği (ÇAÇA), Çocuk Çalışmaları Birimi (ÇOCA), Diyarbakır Barosu, Diyarbakır Büyükşehir Belediyesi Çocuk Müd., Eğitim Sen Genel Merkezi, Gündem Çocuk: Çocuk Haklarını Tanıtma, Yaygınlaştırma, Uygulama ve Uygulamaları İzleme Derneği, Irkçılığa ve Milliyetçiliğe Dur De Girişimi, İnsan Hakları Derneği, İstanbul Çocuk Hakları Aktivistleri Grubu, MAZLUMDER, Özgürlüğünden Yok- [7] ................................................ [2] Sorunun Yasal Arka Planı Sorun çocukların şiddet içeren gösterilere katılmaları ve sonrasında gözaltına alınmaları, tutuklanmaları ve hapis cezalarına maruz kalmaları olarak tarif edildiğinde, sorunun geri planındaki hukuki düzenlemeleri ikiye ayırarak incelemek gerekir. Bunlardan ilki çocukların kendilerine özgü mahkemeler yerine, özel yetkili ağır ceza mahkemelerinde yargılanmasını öngören düzenlemeleri içerir. İkinci başlıkta ise çocukların eylemlerine uyan suç tipinin tasnifinde kullanılan yasal düzenlemeler ele alınmaktadır. [2.1] Çocuklara özgü mahkeme kuralı ve özel yetkili mahkemelerde yargılanma [8] Türkiye’de çocukların kendilerine özgü mahkemelerde yargılanması prensibi ilk olarak 1979 yılında kabul edilen 2253 sayılı “Çocuk Mahkemelerinin Kuruluş, Görev ve Yargılama Usulleri Hakkında Kanun” ile kabul edilmiştir. Ancak bu Kanun, çocuk mahkemelerinin görev alanını 15 yaşından küçük çocuklar ve genel mahkemelerin görev alanına giren suçlar ile sınırlandırmıştır. Buna göre 15 yaşından büyük çocuklar, genel mahkemelerde, Devlet Güvenlik Mahkemeleri’nin görev alanına giren suçlar ile itham edilen çocuklar ise Devlet Güvenlik Mahkemeleri’nde yargılanmaktaydı (madde 6). 30.07.2003 tarihinde yapılan bir Kanun değişikliği ile bu istisna kaldırılmış ve suç ve yaşa sun Gençlerle Dayanışma Derneği, Sosyal Hizmet Uzmanları Derneği Genel Merkezi, Travma Çalışmaları Enstitüsü, TUHAD-DER, TİHV, Türkiye Tabipler Birliği (TTB), Vakit Geldi Girişimi www.cocukadalet. com dayalı herhangi bir ayrım olmaksızın bütün çocukların çocuk mahkemelerinde yargılanması esası benimsenmiştir. Aynı tarihlerde Adalet Bakanlığı Kanunlar Genel Müdürlüğü tarafından bir Çocuk Koruma Kanunu tasarısı hazırlamak üzere çalışmalar başlatılmış, hazırlanan Kanun Tasarısı 3.7.2005 tarihinde Türkiye Büyük Millet Meclisi’nde kabul edilmiş, 15.7.2005 tarihli Resmi Gazete’de yayınlanarak yürürlüğe girmiştir. Bu Kanun da, suç ve yaş ayrımı yapmaksızın bütün çocukların çocuk mahkemelerinde yargılanması esasını benimsemiştir. Ancak 29.6.2006 tarihinde Terörle Mücadele Kanunu 9. maddesine getirilen bir ek fıkra ile Çocuk Koruma Kanunu’nda benimsenen ve çocukların kendilerine özgü mahkemelerde yargılanmasını öngören yaklaşımdan vazgeçilmiştir. Bu değişiklik; 15 yaşın üzerindeki çocuklar hakkında Terörle Mücadele Kanunu kapsamındaki eylemler nedeniyle açılan davaların, Ceza Muhakemesi Kanunu’nun 250. maddesinin birinci fıkrasında belirtilen ağır ceza mahkemelerinde görülmesi kuralını içermektedir. Aynı Kanun değişikliğinde, Terörle Mücadele Kanunu kapsamına giren suçlarla ilgili olarak hükmün açıklanmasının geri bırakılması kararı verilmesi, verilen hapis cezasının seçenek yaptırımlara çevrilmesi ve ertelenmesi yasaklanmıştır. Kanun, bu yasağın 15 yaşını doldurmuş bulunan çocuklar için de uygulanması esasını benimsemiştir. Yasa değişikliği öncesi ve sonrasında ceza mahkemelerinde yargılanan çocukların yaş grupları ve mahkeme türlerine göre dağılımı Tablo 1’de yer almaktadır. Bu istatistiklere göre 2007 yılında kendilerine özgü mahkemelerde yargılanmayan çocuk sayısı 63,396’dır. Bu da 2007 yılında yargılanan çocuklardan % 56’97 sinin kendilerine özgü mahkemede yargılanmadığı anlamına gelmektedir. Bu çocuklardan 900’ü özel yetkili ağır ceza mahkemelerinde yargılanmıştır. Bu da yargılanan çocukların % 0,8’nin özel yetkili ağır ceza mahkemelerinde yargılandığını göstermektedir. 2005 yılında CMK 250. maddesinde öngörülen özel yetkili ağır ceza mahkemelerinde yargılanan çocukların 100,000 çocuk nüfusundaki sanık sayısı 1 iken, bu oran 2006 yılında 5’e, 2007 yılında ise 12’ye yükselmiştir.10 Çocuk Ağır Ceza Mahkemeleri’nde ise düşüş söz konusu olmuştur. 2005 yılında çocuk ağır ceza mahkemelerinde yargılanan 9 Bu veriler Adalet İstatistikleri kullanılarak hazırlanmıştır. http://www. adli-sicil.gov.tr/istatistik_2007/çocuk/çocuk1c-2007.pdf 10 http://www.adli-sicil.gov.tr/istatistik_2007/çocuk/çocuk1c-2007.pdf çocukların 100,000 çocuk nüfusundaki sayısı 365, 2006 yılında 130, 2007 yılında ise 56’dır. Çocuk mahkemelerinde ise bu oran 2005 yılında 310, 2006 yılında 747, 2007 yılında ise 600 olarak tespit edilmiştir. [2.2] Eyleme uyan suç tipinin belirlenmesi Gösterilere katılan çocuklar hakkında açılan davalar TCK’nın 152/1-a, 220, 314/2, TMK 7/2 maddelerine ve 2911 Sayılı Yasa’ya muhalefetten açılmaktadır. Türk Ceza Kanunun 220. maddesi “suç işlemek amacıyla örgüt kurma” suçunu düzenlemektedir. Buna göre: a. Örgüte üye olma eylemi bir yıldan üç yıla kadar hapis cezası ile cezalandırılacaktır. Kanun, örgüte üye olmamakla birlikte örgüt adına suç işleyen kişilerin de, örgüte üye olmak suçundan cezalandırılmasını öngörmektedir. b. Örgütün silahlı olması halinde, verilecek ceza dörtte birinden yarısına kadar artırılacaktır. c. Örgütün veya amacının propagandasını yapmak ise, bir yıldan üç yıla kadar hapis cezası ile cezalandırılacaktır. Yargıtay Ceza Genel Kurulu’nun 2007/9-282 sayı ile 04.03.2008 tarihinde verdiği karar dayanak gösterilerek Türk Ceza Kanunu 314. maddesinin gösterilere katılan bütün çocuklar hakkında uygulandığı iddia edilmektedir. Bu kararda Yargıtay Ceza Genel Kurulu, 314. maddede “örgütün faaliyetleri doğrultusunda işlenen suçlarda ayrıca bir sorumluluk esasının kabul edildiği” görüşünden hareketle, bir gösteri ile ilgili olarak örgütün genel çağrısının [11] bulunmasını, bu gösteriye katılanlar bakımından örgüt adına hareket etme eylemi için yeterli delil olarak nitelemiştir. Bu karar hukukçuların itiraz noktalarından bir diğerini oluşturmaktadır. Görüşme yapılan hukukçular bir çocuğun gösteriye hangi saikle katıldığını ispat etmenin mümkün olmadığını belirtilmektedirler. Yapılan görüşmelerde çocukların da katıldığı gösterilerin hepsinin aynı nitelikte olmadığı, farklı biçimlerdeki bütün gösterilerin tek tip bir yasadışı gösteri gibi gösterildiği ve algılandığı belirtilmiştir. Sözü edilen gösteri biçimleri: • Mahalle arasında gelişen protesto eylemleri, • DTP, İHD gibi yasal örgütlerin basın açıklamasına izin verilmemesi veya basın açıklaması sonrasında yürümeye izin verilmemesini protesto, [12] • Abdullah Öcalan’ın yakalanması, cenazelerin verilmemesi gibi bazı olayları protesto gösterileri, • Nevruz benzeri kutlama gösterileri, • Parti mitingleridir. Yapılan görüşmelerde bu gösterilere çocukların katılma biçimlerinin tek kaynaktan yönlendirme gibi algılanmasının doğru bir tespit olmadığına dikkat çekilmiş ve çocukların çok farklı sebeplerle gösterilerin içinde bulunabileceği vurgulanmıştır: • Bazı çocuklar zaten sokaktalar, gösteriler sırasında da kendiliğinden orada oluyorlar, • Çocuklar için bu tür etkinlikler neredeyse tek eğlence biçimi, • Çocuklar için taş atma vb. hareketler görüşlerini ifade etmenin ve bir şeyi protesto etmenin bilinen tek biçimi ve onlara tanınan başka bir görüş ifade etme yolu yok, • Çocuklar içinde bulundukları koşullar nedeniyle tepkilerini böyle dile getiriyorlar, • Çocuklar örgüt tarafından bu gösterilere çağrılıyor, • Çocuklar aileleri tarafından yönlendiriliyorlar. Konunun tarafları arasında bu görüşler değişiklik göstermekle birlikte, herkesin istisnasız üzerinde birleştiği görüş, çocukların hiç yoksa bir kısmının tamamen oyun saiki ile hareket ettikleridir. Bu tezi doğrulayan şu gerekçeler gösterilmektedir: • Çocukların bazılarının babaları korucu veya polis, • İfadelerinde okuyup polis, öğretmen ve benzeri kamu görevlerinde görev almak isteyen çocuklar bulunmaktadır, • Aynı çocuklar gösteri sonrasında polisle birlikte konser vermekte veya top oynamaktadır. 2006 yılında Türk Ceza Kanunu’nun 220. maddesine muhalefetten açılan toplam 1,237 davanın 215’i 18 yaşının altındaki çocuklara yöneliktir. Bunlardan 20 çocuk 12-15 yaş grubunda, 195 çocuk ise 16-18 yaş grubundadır. 2007 yılında açılan toplam 1,232 davanın ise 207 tanesi 18 yaşın altındaki çocuklara yöneliktir. 12-15 yaş grubu çocuklar hakkında bu maddenin ihlali sebebiyle 17 dava açılmıştır. 16-18 yaş grubu içinse 190 dava açılmıştır.11 11 http://www2.tbmm.gov.tr/d23/7/7-6037c.pdf [13] Kaynak: Polis Gazetesi - 06.02.2009 [14] 2006 yılında TCK 220. maddesi ile ilgili 12-15 yaş grubunda hiç mahkûmiyet veya beraat kararı verilmemişken, 1618 yaş grubunda 6 mahkumiyet, 9 beraat kararı verilmiştir. 2007 yılında 12-15 yaş grubunda 1 mahkumiyet, 5 beraat kararı bulunmaktadır. Aynı yıl 16-18 yaş grubunda 14 mahkûmiyet, 42 beraat kararı bulunmaktadır. Türk Ceza Kanunun 314. maddesi; devletin güvenliğine ve anayasal düzene karşı suç işlemek amacıyla silahlı örgüt kurulması ve yönetilmesi suçunu düzenlemektedir. Bu suç için öngörülen ceza 10 yıldan 15 yıla kadar hapis cezasıdır. Bu örgüte üye olanlara verilecek ceza ise 5 yıldan 10 yıla kadar hapis cezasıdır. 2006 yılında Türk Ceza Kanunu’nun 314. maddesine muhalefetten açılan toplam 1,145 davanın 198’i 18 yaşının altındaki çocuklara yöneliktir. Bunlardan 19’u 12-15 yaş grubuna 179 tanesi ise 16-18 yaş grubuna yöneliktir. 2007 yılında açılan 1,094 davanın 215 tanesi 18 yaşının altındaki çocuklara yöneliktir. 12-15 yaş grubu çocuklar hakkında bu maddenin ihlali sebebiyle hiç dava açılmamıştır. 16-18 yaş grubu içinse 215 dava açılmıştır. 2006 yılında TCK 314. maddesi ile ilgili 12-15 yaş grubunda hiç mahkûmiyet veya beraat kararı verilmemişken, 16-18 yaş grubunda 3 mahkumiyet, 22 beraat kararı verilmiştir. 2007 yılında 12-15 yaş grubunda 1 beraat; 16-18 yaş grubunda ise 31 mahkumiyet, 50 beraat kararı bulunmaktadır. Türk Ceza Kanunu 152/1a maddesi kamu malına zarar vermeyi düzenlemekte ve bu fiili gerçekleştirenler için 1 yıldan 6 yıla kadar hapis cezası verilmesini öngörmektedir. 2911 sayılı Toplantı ve Gösteri Yürüyüşleri Hakkında Kanun’a muhalefet ise, izinsiz gösteri ve yürüyüş yapmayı ifade etmektedir. Bu eylemler için öngörülen ceza ise 1 yıl 6 aydan 3 yıla kadar hapis cezasıdır. Terörle Mücadele Kanunu 7/2 maddesi ise, terör örgütünün propagandasını yapma suçunu düzenlemekte ve bu suçu işleyenler hakkında 1 yıldan 5 yıla kadar hapis cezası verilmesini öngörmektedir. Çocuklar yukarıda açıklanan suçların bir veya birkaç tanesinden, çok yüksek ceza talepleri ile yargılanabilmektedir. Aşağıda bunu açıklamak üzere bir örnek yer almaktadır. Sayın Başbakan’ın kente geldiği gün, gerçekleştirilen eylemlere katıldığı iddia edilen çocuklar (Ş.B. (13), E.B. (13), V.D. (13), Ö.S. (14), M.A. (14) ve Ş.A.(14)); kentin farklı bölgelerindeki yasadışı gösterilere katılmak, güvenlik güçlerine taş atmak, lastik yakmak, yasadışı poster ve döviz açmak, lastik yakanlara gözcülük yapmak, polis araçlarının camlarını kırmak, yolu trafiğe kapatmak, Öcalan lehine slogan atmak ile suçlanmakta ve bu suçların iddianamede şu şekilde yer aldığı belirtilmektedir: [15] • Kurulan silahlı örgüte üye olmamakla birlikte örgüt adına suç işlemiş olmak nedeniyle “örgüt üyesi gibi” cezalandırılma (5 yıldan 10 yıla kadar hapis), • Suçun terör örgütünün eylemi kapsamında işlenmesi nedeniyle cezanın yarı oranında artırılması, • Terör örgütünün propagandasını yapmak (1 yıldan 5 yıla kadar hapis), • Yasadışı toplantının dağılması sırasında mukavemet etmek (5 yıldan 8 yıla kadar hapis). [16] Böylece çocukların toplam 13 yıldan 28 yıla kadar hapisle cezalandırılmaları istenmiş olmaktadır. Çocukların yaş durumlarına göre bu cezada indirim yapılacak olmakla birlikte 12-15 yaş grubunda indirim oranı olan ½ uygulandığında 6 yıl 6 aydan 14 yıla kadar; 16-18 yaş grubunda indirim oranı olan 1/3 uygulandığında ise yaklaşık 9 yıldan 18 yıla kadar hapis cezası söz konusu olabilecektir. Çocukların yetişkinler gibi yargılanması ve verilecek cezaların ertelenmesinin veya seçenek yaptırımlara çevrilmesinin yasaklanması, caydırıcı olma niyeti ile açıklanmaktadır. Oysa, aşağıda yer alan örnekler ve verilerden de görüleceği üzere, terör suçları ile ilgili olarak 2005 – 2007 arasında çocuklar hakkında açılan dava sayılarında bir artış meydana gelmiştir. Çocukların yaşları ve eylemleri ile verilen cezalara ilişkin örnekler şöyledir;12 1. A.T. (17), Abdullah Öcalan’ın yakalanışının yıldönümü dolayısıyla Şakirpaşa Mahallesi’nde yapılan gösteriye katıldıkları gerekçesiyle örgüt üyeliği suçundan 3 yıl 1 ay 15 gün, 5. A.T. (16), ve S.T. (17), Mimar Sinan Açık Hava Tiyatrosu’nda yapılan Nevruz mitinginde yasadışı slogan attıkları, Öcalan’ın resmini taşıyarak örgüt propagandası yaptıkları gerekçesiyle örgüt propagandası yapmak suçundan 1 yıl, 6. V.Ç. (17), ve Ö.Ç. (17), Barbaros Mahallesi’nde lastik yakıp, slogan atıp, polislere taş atıkları gerekçesiyle örgüt üyeliğinden 4 yıl 2 ay, 7. M.A.A. (17), örgüt propagandası yapmak suçundan 1 yıl, 8. M.M. (15), ve M.K. (16), DTP’nin, Bağımsız Milletvekili Nazmi Gür’e destek amaçlı düzenlediği mitinge katılarak yasa dışı slogan atmak ve örgüt propagandası yapmak suçundan 1 yıl hapis. Belirtilen karar örneklerinde en düşük ceza 6 ay hapis cezası, en yüksek ceza ise 8 yıl olarak görülmektedir. Ayrıca, farklı zamanlarda birden fazla gösteriye katılmış olan çocukların toplam cezalarının, bu miktarların çok daha üstünde olma ihtimali de bulunmaktadır. Raporlarda çocukların adları kısaltma biçiminde yer aldığı için, takibi [17] mümkün olamamaktadır. Örneğin Adana’da 2008 yılında verilen kararlara ilişkin sivil toplum kuruluşlarının raporunda yer alan Ö.Ç. ve V.Ç. gibi kısaltmaların aynı çocukların isimleri olması durumunda bu çocuklar hakkında 2008 yılı içinde en az iki ayrı gösteriye katılmak sebebiyle dava görülmüş ve karar verilmiş olma ihtimali bulunmaktadır. Rapora göre 28.12.2007 tarihinde katıldıkları gösteriler ile ilgili kovuşturma sonucunda 4 yıl 2 ay, 23.3.2008 tarihinde katıldıkları gösteriler ile ilgili kovuşturma sonucunda ise 1 yıl hapis cezası almış olma ihtimalleri bulunmaktadır. Bahsedilen dönem yaklaşık 3 aylık bir dönemdir. Gösterilerin 2006 yılından bu yana devam ettiği düşünülürse, çok daha yüksek ceza miktarları ile karşı karşıya kalan çocukların bulunduğu düşünülebilir. Bu riskle karşı karşıya olan çocukların da araştırılması gerektirmektedir. [3] Sorunun Uygulamalardan Kaynaklanan Yönleri [3.1] Gözaltına almanın son çare olarak kullanılmaması Görüşülen hukukçular ve sivil toplum kuruluşu temsilcileri, gösterilere katılan çocuklar bakımından gözaltına almanın tek çare olarak ve yaygın biçimde kullanıldığını ileri sürmektedirler. Kolluk kuvvetleri ise, olaylara karışan pek çok çocuk bulunduğunu, bunlardan çok azı hakkında soruşturma başlatıldığı görüşündeler. İnsan Hakları Derneği Adana Şubesi verilerine göre;14 Adana’da son 11 ayda 264 çocuk gözaltına alındı, 69’u tutuklandı; 105 çocuk savcılıktan, 95 çocuk ise gözaltı biriminden serbest bırakıldı. 2006 yılında Adana ilinde suç işlediği iddiası ile emniyet birimlerine gelen ve getirilen çocuk sayısı 2,729 olup; bu çocuklardan 2,648’i erkek, 121’i kız çocuktur. Bu çocukların ilk üç sırada yer alan suç tiplerine göre dağılımı 2006 yılı içerisinde şöyledir: 832 çocuk hırsızlık suçlaması ile, 666 çocuk yaralama iddiası ile, 241 çocuk oto hırsızlığı ve otodan hırsızlık suçlaması ile gözaltına alınmıştır. Bu istatistiklerde 27 ayrı suç tasnifi yapılmış ve bir de diğer kategorisi oluşturulmuştur. Bu suçlama ile gözaltına alınan çocuk sayısı itibariyle “terör suçu” 2006 yılında Adana ilinde 23. sırada yer almaktadır. 14 İnsan Hakları Derneği Adana Şubesi’nin 29.11.2008 tarihli basın açıklaması [19] 2007 ve 2008 yıllarına ait resmi istatistikler yayınlanmadığı için tam bir karşılaştırma yapılamamaktadır. Ancak Adana ilinde Emniyet Genel Müdürlüğü Çocuk Şube Müdürlüğü’ne gelen ve getirilen çocuklara ait istatistikler üzerinde değerlendirme olanağı bulunmaktadır. Buna göre 2008 yılında emniyet birimlerince suç işledikleri iddiası ile yakalanarak gözaltına alınmış olan 1,106 çocuktan, 173’ü terör eylemleri ve izinsiz gösteri düzenlemek suçlaması ile gözaltına alınmıştır, ayrıca yakalama sebebi savcılıkça verilen yakalama emri olarak bildirilmiş olan dolayısıyla yöneltilen suçlama bilinmeyen 69 çocuk bulunmaktadır. Adana ilinde suç işlediği iddiası ile emniyet birimlerine gelen ve getirilen çocukların ilk üç sırada yer alan suç tiplerine göre dağılımı 2008 yılı içerisinde şöyledir: 414 çocuk hırsızlık [20] suçlaması ile, 173 çocuk terör eylemleri ve izinsiz gösteri düzenlemek iddiası ile, 137 çocuk uyuşturucu bulundurmak iddiası ile gözaltına alınmıştır. Adana ilinde 2006 yılı ile 2008 yılı arasında emniyet birimlerince gözaltına alınan çocuk sayılarında düşüş görülürken, terör suçlaması ile gözaltına alınan çocuk sayısında ciddi bir artış bulunmaktadır. 2006 yılında Adana’da emniyet birimlerince terör suçlaması ile gözaltına alınan çocukların toplam emniyet birimlerince gözaltına alınan çocuklara oranı % 0,4 iken; 2008 yılında bu oran % 15,6’ya yükselmiştir. Güvenlik Birimlerine Gelen ve Getirilen Çocuk İstatistikleri 2006 verilerine göre 27 ilde “terör suçları” iddiası ile gözaltına alınan 304 çocuğun yaş gruplarına göre dağılımı Tablo 3’de yer almaktadır. [Tablo 3] 2006 yılında “terör suçları” iddiası ile gözaltına alınan çocukların yaşlarına göre dağılımı15 Yaş 9 10 11 12 13 14 15 16 17 18 Gözaltına alınan çocuk sayısı 1 1 3 2 7 33 43 90 79 45 Güvenlik birimleri, çocuk yaştakilerin gözaltına alınmaları ile ilgili eleştirileri, şiddet içeren gösteriler sırasında gözaltına alınan kişinin yaşının her zaman kolay tespit edilememesi ve gösterilere katılan çocuklara oranla gözaltına alınan çocuk sayısının azlığı ile yanıtlamaktadırlar. Güvenlik birimleri, ancak çok fazla olaya karışmış olanların gözaltına alındıklarını belirtirken, konu ile ilgili diğer taraflar gözaltına almaların her zaman sabit bir suçlamaya dayanmadığını ileri sürmektedir. Bazen olay sonrası eylemciler dağılırken yolda görülen çocukların da gözaltına alınabildikleri, son olaylardan sonra mahallelere gelen polisin çocukların ellerine bakarak elinde taş izi olanları gözaltına aldığı ve polis tarafından tutulan yakalama tutanağının da suçluluğa karine teşkil edecek biçimde kullanıldığı bazı görüşülenler tarafından iddia edilmektedir. [3.2] Yaşam hakkı ihlalleri, işkence ve kötü muamele iddiaları Gösteriler sırasında veya sonrasında yapılan gözaltı işlemleri sırasında kolluk güçlerinin kötü muamele ve keyfi uygulamalarına ilişkin çeşitli şikayetler bulunmaktadır. Öte yandan gösterilere müdahale sırasında hayatını kaybeden veya yaralanan pek çok çocuk bulunmaktadır. Çocuklar 15 Güvelik Birimlerine Gelen ve Getirilen Çocuk İstatistikleri 2006 TUİK [21] İçin Adalet Çağrıcıları Grubu tarafından temin edilen bilgiye göre 2000 – 2009 yılları arasında güvenlik güçlerinin müdahalesi sonucu hayatını kaybeden çocuklar: 2000 Serdar Günerci (17) Diyarbakır Welat Şedal (10) Yüksekova İsmail Şedal (8) Yüksekova 2004 Uğur Kaymaz (12) Mardin (21 Kasım) 2006 Abdullah Duran (9) Diyarbakır (29 Mart) Enes Ata (8) Diyarbakır (30 Mart) Erkek (8) Diyarbakır (30 Mart) Fatih Tekin (3) Batman (Mart) Ahmet Araç (17) Mardin (Mart) Mahsum Mızrak (17) Diyarbakır (3 Nisan) Emrah Fidan (17) Diyarbakır (3 Nisan) Mizgin Özbek (10) Batman (5 Eylül) 2008 Yahya Menekşe (12) Şırnak (15 Şubat) 2009 Abdülsamet Erip (14) Hakkari (23 Nisan) [22] Adana’da son 11 ayda gözaltına alınan 40 çocuğa gözaltına alınma esnasında ve polis otosunda dayak atıldığı iddiası ile İnsan Hakları Derneği’ne başvuruda bulunulurken, 20 çocuğun da adliyeye getirilirken kollarına kelepçe vurulduğu anlatılmaktadır.16 Avukat Çemşit Tabak’ın İHD Adana Şubesi’ne yaptığı başvuruda, müvekkili olan çocuklara gözaltına alınma esnasında dayak atıldığını, bu dayak ve işkenceden dolayı 16 İnsan Hakları Derneği Adana Şubesi’nin 29.11.2008 tarihli basın açıklaması müvekkillerinin vücutlarının çeşitli yerlerinde morluklar ve darp izlerinin olduğunu, müvekkillerinin bu durumu savcılık ifadeleri esnasında da dile getirdiğini bildirdiği ileri sürülmektedir.17 Bu başvuruya konu çocukların yaşları ve tutukluluk hallerine ilişkin bilgiler şöyledir: Ü.B. (16 yaşında tutuklandı), R.S. (16 yaşında tutuklandı), V.Y. (16 yaşında tutuklandı), M.Ö. (16 yaşında tutuklandı), O.S. (16 yaşında), B.Ö. (15 yaşında tutuklandı), SK (16 yaşında tutuklandı), İ.G. (15 yaşında tutuklandı), M.O. (16 yaşında tutuklandı), Ö.Ö. (15 yaşında tutuklandı), M.K. (16 yaşında tutuklandı), İ.D. (16 yaşında tutuklandı), Ş.A. (16 yaşında tutuklandı), L.Ö. (14 yaşında), Mahir Özdemir (13 yaşında), D.Ç. (13 yaşında), E.A. (13 Yaşında), Ö.D. (14 yaşında), C.K. (14 yaşında), İ.S. (13 yaşında), S.Ö. (13 yaşında). [23] Aynı raporda, L.Ö., Ş.Ö. ve Ş.A.’ya ilişkin bireysel başvurulara dayalı verilen bilgide, yakalama anında saçlarından sürüklendiği, copla vurulduğu ve küfür ve hakaret edildiği iddia edilmektedir. Bir başka başvuruya dayalı olarak ise Seyhan Belediyesi İlkokulu 7. Sınıf öğrencisi B.E.’nin (14) 12.11.2008 günü sabah saat 10.00 sularında derste bulunduğu sırada sınıfından gözaltına alındığını ileri sürülmektedir.18 Mazlum-Der Diyarbakır Şubesi’nin Çocuk Hakları Raporu’nda yer alan 3.2.2009 tarihli bir haberde Van ilin17 Kaynak: İHD Adana Şubesinin Adana’da Ekim Ayında Yapılan Gösterilerde Gözaltına Alınanlara İşkence ve Kötü Muamele Yapıldığına İlişkin Araştırma ve İnceleme Raporu 18 İHD Adana Şubesi 13.11.2008 tarihli açıklama de gözaltına alınan M.B.’nin (13 yaşında) kaba dayak ve tacize maruz kaldığı iddiası ile İHD Van Şubesi’ne başvurduğu bildirilmektedir. Sağlık mazeretlerinin dikkate alınmadığına ilişkin iddialara da örnekler verilmektedir.19 Diyarbakır’daki gösterilerde gözaltına alınıp tutuklanan ve halen Diyarbakır E Tipi Cezaevi’nde tutulan 15 yaşındaki Ş.A.’nın epilepsi hastası olduğu, bunun bildirilmesi ve doktor raporlarının sunulmasına rağmen, adli tıp uzmanınca “ilaçlarını kullanmaya devam etmesi halinde gözetim altında tutulmasında sakınca yoktur” raporu verildiği ve bu rapora dayalı olarak da Mahkemenin tahliye taleplerini reddettiği ileri sürülmektedir. Uzun süren duruşmalar da çoğu kez, kötü muamele ya[24] sağını ihlal edici nitelikte olabilmektedir. Görüşmeler sırasında tanık olunan davada, çocuklar adliyeye sabah getirilmiş, duruşma ise ancak akşamüzeri başlayabilmişti. Bu sırada çocuklar, kendilerine yeterli yiyecek verilmediğini bildirmektedirler.20 [3.3] Mahkemelerin tutuklama ve hapis cezasına son çare olarak başvurmadığı iddiası Gözaltına alma konusunda olduğu gibi tutuklama ve hapis cezasına hükmetme konusunda da ÇHS 37. maddesi ve Çocuk Koruma Kanunu’nun 4. maddesinde yer alan “son çare” kuralına uyulmadığı iddia olunmaktadır. Aşağıda yer alan istatistiksel veriler, güvenlik birimlerine gelen ve 19 http://www.polisgazetesi.com/yazdir.asp?ID=586 20 Radikal Gazetesi 20.4.2009 getirilen çocuklar sayısında ve oranındaki artışların, hakkında dava açılan veya karar verilen çocuklar bakımından söz konusu olmadığını göstermektedir. Bu da, gözaltıların son çare olarak kullanılmadığını düşündürtmektedir. Aynı zamanda bu sayılar özellikle Türk Ceza Kanunu’nun 314. maddesinin ihlal edilmesi sebebiyle açılan davalarda da ciddi bir artış olduğunu da ortaya koymaktadır. Resmi olmayan bir kaynakta21 Ağustos 2008 – Şubat 2009 arasında Diyarbakır, Adana, Gaziantep ve Şırnak’ta 251 çocuk hakkında, “örgüt üyesi olmamakla birlikte örgüt adına suç işlemek”ten dava açıldığı ve bu çocuklardan 198’inin halen Diyarbakır ve Adana başta olmak üzere farklı illerdeki cezaevlerinde tutuklu olarak bulundurulduğu ileri sürülmektedir. Baro kayıtlarına göre, son bir yıl içinde Diyarbakır’daki olaylarda “Terörle Mücadele Yasası’na muhalefet” suçundan gözaltına alınan 497 çocuk için avukat talep edildiği bildirilmektedir. Adli istatistiklerde suç türlerine göre tutukluluk durumuna ilişkin veri bulunmadığından bu konuda bir değerlendirme yapılamamıştır. Ancak ziyaret edilen illerde, tutukevlerinin kapasitesinin üzerinde dolu olduğu, Diyarbakır E Tipi Kapalı Ceza İnfaz Kurumu’nda tutuklu bulunan çocukların bir koğuşta 30-35 kişi kaldıkları, “terör suçları” sebebiyle tutuklanan çocukların koğuşlarında mevcudun 17-24 arasında değiştiği hem çocuklar hem de avukatlar tarafından dile getirilmiştir. Haklarındaki davalar 2008 yılı içerisinde karara bağlanmış çocukların tutukluluk sürelerine ilişkin örnekler: 21 Sabah Gazetesi 6.2.2009 [25] 1. M.Y. (Tutuklanma tarihi: 28.3.2008; tutukluluk süresi 4 ay 20 gün) Örneğin F.A. toplam cezası olan 8 ayın 6’sını tutuklu geçirmiş bulunmaktadır. Kısa süreli hürriyeti bağlayıcı bir ceza nedeniyle 6 ay tutuklu kalmak, özgürlüğü kısıtlayıcı tedbirlerin son çare olması ve mümkün olan en kısa sürede sona erdirilmesi prensibi ile çelişkilidir. Bu sürelerde çocuklar okula devam edememektedirler. Yapılan görüşmelerde, tutukluluk öncesi okula giden çocukların uzun süren tutukluluktan sonra tahliye olduklarında okul ile bağlarının zayıfladığına ve bazen de tamamen koptuğuna ilişkin gözlemler aktarılmıştır. Bazen de mahkemelerin iddianameleri, disiplin soruşturması yapılması talebi ile okula gönderdikleri bildirilmiştir. Bir başka raporda S.K., A.Y., M.K. ve F.E. isimli 4 çocuğun 29.10.2008 tarihinde Tarsus’ta yapılan gösterilerde gözaltına alındığı Mart 2009’da Rapor düzenlendiğinde hala tutuklu oldukları ve 6 aydır mahkeme önüne çıkarılmadıkları iddia edilmektedir. Ceza İnfaz Kurumu İstatistikleri çocuklarla ilgili olarak, suç türü ve yaş ayrımına göre tutuklu ve hükümlü sayılarını içermediğinden, bu suçlar sebebiyle hakkında tutuklama kararı verilmiş olan çocuklarla ilgili bir değerlendirme yapma olanağı bulunmamaktadır. Ancak açılan dava sayıları ve mahkemelerin verdikleri karar sayıları üzerinden cezalandırma eğilimi hakkında bir değerlendirme yapma olanağı bulunmaktadır. Gözaltına alınan çocukların yetişkinlere oranında yükselme varken, açılan davalar bakımından aynı eğilimin bulunmadığı görülmektedir. 2006 yılında Terörle Mücadele Kanunu’na muhalefet iddiası ile hakkında dava açılan yetişkin sayısı 3,708, çocuk [27] sayısı ise 299’dur. Bu yıl hakkında TMK’ya muhalefet nedeniyle dava açılan çocukların yetişkinlere oranı % 8.6’dır. 2007 yılında ise, aynı suçlama ile hakkında dava açılan yetişkin sayısı 7,275, çocuk sayısı 438, hakkında dava açılan çocukların yetişkinlere oranı ise % 6’dır. Diğer suçlarda yetişkinlere oranda büyük bir değişiklik gözlenmemektedir. TCK 314. maddesi gereğince 2006 yılında 2,860 yetişkin ve 198 çocuk hakkında dava açılmış olup, çocukların yetişkinlere oranı % 6.9’dur; 2007 yılında ise bu oran % 6.5 olmuştur. TCK 220. maddesine göre 2006 yılında hakkında dava açılan yetişkin sayısı 8,167 iken, çocuk sayısı 215’tir ve çocukların yetişkinlere oranı % 2.6’dır. 2007 yılında ise sayılar 8,921/207 olarak değişmiş ve oran % 2.3’e düşmüştür. [28] 2006 – 2007 yıllarında hakkında dava açılan çocuk sayısı yükselirken, hakkındaki dava karara bağlanan çocuk sayısında düşüş görülmektedir. Kararlar incelendiğinde ise, erteleme vb. mahkûmiyet ve beraat dışındaki karar türlerinde düşüş, beraat ve mahkûmiyet karar oranlarında ise yükselme söz konusudur. Örneğin 2006 yılında TMK’ya muhalefet suçundan yargılanan 335 çocuktan % 2.99’u hakkında mahkûmiyet, % 4.3’ü hakkında beraat, % 89.85’i hakkında diğer kararlar verilirken; 2007 yılında bu oran % 47 mahkûmiyet, % 18.53 beraat, % 33.3 diğer karalar şeklinde değişmiştir. Mahkemelerin karar eğilimindeki değişikliği anlamak için yetişkin sanıklar hakkında aynı yıllarda verilen kararlara bakılabilir. 2006 yılında Terörle Mücadele Kanunu’na muhalefet sebebiyle yetişkinler hakkında verilen toplam karar sayısı 3,683 olup, bunlardan 599’u mahkûmiyet, 317’si beraat, 2,767’si diğer kategorisinde yer almaktadır. 2007 yılında toplam karar sayısı 4,536 olmuş, bunlardan 1,505’i mahkûmiyet, 600’ü beraat, 2,431’i diğer kategorisinde yer almıştır. Yetişkinler hakkındaki kararların yıllar içerisinde toplam karara oranı ise şöyle bir değişiklik göstermiştir: 2006 yılında TMK’ya muhalefetten verilen toplam kararın % 16.2’si mahkûmiyet, % 8.6’sı beraat, % 75’i diğer iken; 2007 yılında bu oran % 33 mahkûmiyet, % 13.2’si beraat, % 53 diğer olarak değişmiştir. Bu yıllar içerisinde karara bağlanan dava sayısı ve karar türlerine göre dağılımı ise Tablo 4’te yer almaktadır. Burada da görüleceği üzere dava açılan çocuk oranında yetişkinlere göre düşüş yer alırken mahkûmiyet oranlarında artış söz konusudur. Yetişkinlerde TMK’ya muhalefet suçundan verilen mahkûmiyet oranı % 16.2’den % 33’e çıkmış, yaklaşık iki kat bir artış olmuştur. Çocuklarda ise % 4.7’den % 47’ye yükselmiş, yaklaşık 10 kat artmıştır. Mahkûmiyet TMK’ya Davaların daha iyi hazırlanması gibi faktörler göz önünde bulundurulabilecekse de, çocuklar hakkında verilen beraat kararı oranındaki artış, mahkûmiyet kararlarındaki 22 Bu veriler Adalet İstatistikleri esas alınarak hazırlanmıştır. [29] artışın sadece bu sebebe dayandırılamayacağını göstermektedir. [30] Çocukların, gösterilere katılmaları ve bazı olayları protesto etmelerini, yasa uygulayıcıların Devlet’e ve onunla özdeşleşerek kendilerine yönelik bir saldırı gibi algıladıkları ve bu nedenle de hoşgörüsüz davrandıkları düşüncesi iddia edilmektedir. Bu görüşü desteklemek üzere, çocuklara karşı suç işleyen kamu görevlilerinin cezasız kalması örnek gösterilmektedir. Aynı zamanda da TESEV tarafından 2007 yılında yapılan araştırma sonucunda yayınlanan Yargıda Algı ve Zihniyet Kalıpları Raporu görüşü destekler bir referans olarak kullanılmaktadır. Derinlemesine görüşme tekniği kullanılan ve 51 hakim ve savcı ile gerçekleştirilen bu araştırmada “insan hakları devletin güvenliği açısından tehdit oluşturabilir mi” sorusunu “evet” diye yanıtlayanların oranı % 51’e ulaşırken; “hayır” diye yanıt verenlerin oranının ise, % 28’de kaldığı rapor edilmektedir. “Devlete karşı işlenmiş suçlar ile devlet görevlileri tarafından işlenmiş suçlara yargının yaklaşımında bir farklılaşma eğilimden söz edilebilir mi”, sorusuna ise % 45, “evet, maalesef var”; % 24 ise “evet, olması da lazım” yanıtı verildiği belirtilmektedir. Ayrıca, Diyarbakır ve Adana gibi birkaç il dışında çocukların tutuldukları kurumlarda yetişkinlerle temaslarının önlenemediği, bazı illerde ise yetişkin koğuşlarında kaldıkları iddia olunmaktadır. 2. KISIM Bu kısım, yapılan görüşmelerde ifade edilen görüşler ve sivil toplum kuruluşlarının yazılı önerileri dikkate alınarak hazırlanmıştır. ÖNERİ 1 Öncelik çocukların yaşama hakkının güvence altına alınmasına verilmeli ve çocuğa karşı işkence ve kötü muamelenin önlenmesin için bu tür eylemlere karşı “0” tolerans prensibi ile hareket edilmelidir. Gösteriler ve sonrasında yapılan müdahalelerin çocukların yaşam haklarına yönelik ciddi bir tehlike oluşturduğu görülmektedir. Bu üzerinde durulması ve önlenmesine yönelik tedbirler bakımından zaman kaybedilmeden harekete geçilmesi gereken bir durumdur. Gösteriler ve bunların yarattığı tehdit her ne olursa olsun, kamu gücünü kullananlar tarafından çocukların kötü muameleye maruz bırakılmaları, dövülmeleri ve ölümlerine sebebiyet verecek müdahaleler ile karşı karşıya bırakılmaları kabul edilemez. Bu ilke, bu alanda çalışan herkesin görevini yerine getirirken dikkate alacağı birinci prensip olarak kabul edilmelidir. Bu raporda yer alan bütün diğer öneriler de bu sonucu [31] sağlamaya yönelik olmakla birlikte, diğer önerilerin tam olarak hayata geçirilmesine kadar beklenemeyeceğinden, çocuk ölümleri ve yaralanmalarını engelleyecek kısa vadeli bir eylem planı bulunmalıdır. Kısa vadede çözüm sağlayacak tedbirlerden biri kamu otoritelerinin bu konuda net bir tavır almalarıdır. Sorumlu kurumların yetkilileri ile bir toplantı yapılarak konu değerlendirilmeli ve bu konuda kendileri ile sürekli bir işbirliği yapılmalıdır. ÖNERİ 2 Çocukların kendilerine özgü mahkemelerde, kendilerine özgü usullerle yargılanmalarının sağlanması için gerekli yasal değişiklik yapılmalı ve çocuk mahkemeleri yaygınlaştırılmalıdır. [32] Hem uygulamacılar hem de konu ile ilgili uzmanlar, gösterilere katılan çocukların yetişkinler gibi yargılanması ve cezalandırılmasını ikinci kez çocuğun mağdur edilmesi olarak görmekte ve çocukların kendilerine özgü mahkemelerde yargılanmaları için gerekli yasal değişikliklerin yapılmasını önermektedir. Bu amaca ulaşılabilmesi için hem birden fazla yasal değişiklik yapılması hem de çocuk mahkemelerinin yaygınlaştırılması ve gerek personel gerekse alt yapı eksikliklerinin giderilmesi gerekmektedir. Terörle Mücadele Kanunu 9. ve 13. maddeleri değiştirilmelidir. B.M. Çocuk Haklarına Dair Sözleşmesi’nin 40. maddesi, çocukların kendilerine özgü kanunlar ile kendilerine özgü mahkemelerde yargılanmalarını adil yargılanma hakkının bir unsuru olarak kabul etmektedir. Anayasa’nın 90. mad- desi gereğince, Türkiye tarafından imzalanmış ve onaylanarak yürürlüğe girmiş bulunan Sözleşme, iç hukuk hükmü niteliğindedir. Bu nedenle, çocukların kendilerine özgü mahkemelerde yargılanma hakkı, İnsan Hakları Avrupa Sözleşmesi’nin 6. maddesinde yer alan adil yargılanma hakkının bir unsuru olan “kanunla kurulmuş, tarafsız ve bağımsız yargı yerinde yargılanma” hakkının da koruması altındadır. T.C. Anayasası’nın 141. maddesi de “küçüklerin yargılanması hakkında kanunla özel hükümler konulmasını” öngörmektedir. Bu düzenlemeler çerçevesinde, Terörle Mücadele Kanunu’nun 9 ve 13. maddeleri, çocukların yetişkinler ile aynı mahkemelerde ve aynı usuller ile yargılanmalarını öngörmesi sebebiyle B.M. Çocuk Haklarına Dair Sözleşmesi, İnsan Hakları Avrupa Sözleşmesi ve Anayasa’nın 141. maddesine aykırıdır. Terörle Mücadele Kanunu’nun 9 ve 13. maddeleri aynı zamanda ayrımcılık yasağı (ÇHS md. 2), eşitlik ilkesi (Anayasa md.10), çocuğun yararına önceliğin verilmesi ilkesi (ÇHS md. 6, ÇKK md.4), hukuk devleti ilkesi (Anayasa md.2) ve hiç kimsenin kanunen tâbi olduğu mahkemeden başka yerde yargılanamayacağı ilkesine (Anayasa md.37) de aykırılıkla eleştirilmektedir.1 Avrupa İnsan Hakları Mahkemesi de 2008 yılında Güveç v. Türkiye davasında, 15 yaşında bir çocuğun Devlet Güvenlik Mahkemesi’nde yargılanmasını incelemiş ve İHAS 6. maddesine aykırılık tespit etmiştir. 1 Terörle Mücadele Kanunu’nda Değişiklik Yapılmasına Dair Kanun’un Çocuk Hakları Bağlamında Değerlendirilmesine Dair Rapor, İstanbul Barosu Yayınları Mart - 2007 [33] Terörle Mücadele Kanunu’nun 13. maddesi ise, hapis cezasının bir başka yaptırıma çevrilmesini ve ertelenmesini yasakladığından, B.M. Çocuk Haklarına Dair Sözleşmesi’nin 37. maddesinde yer alan özgürlüğü kısıtlayıcı tedbir ve cezalara son çare olarak başvurulması ilkesi ile çelişkili olup, uygulamada çocukları ceza hukuku müdahalesi karşısında alternatifsiz bırakmaktadır. [34] Ayrıca bazı uygulamacılar, çocukların gösterilere katılmalarının örgüt üyeliği gibi cezalandırılmasına neden olan Türk Ceza Kanunu’nun 220 ve 314. maddeleri ile Terörle Mücadele Kanunu’nun 5 ve 7. maddelerinin de değiştirilmesini talep etmektedirler. Bu maddelerin uygulamasında çocuklar aleyhine doğan sonuç dikkate alınarak, çocuklara uygulanmaları bakımından bir istisna getirilmesi veya bu maddelerin değiştirilmesi seçenekleri tartışılmalıdır Çocukla ilgili suçlar bakımından “çok suçta tek sorumluluk ilkesi” kabul edilmelidir. Diğer yandan, aynı nitelikteki eylemi birden fazla kez tekrarlayan çocuklar, çok ağır cezalara maruz kalma riski altındadır. Bunun önlenmesi de, çocuk adalet sisteminin önemli ilkelerinden biri olan çok suçta tek sorumluluk ilkesinin yasa ile kabul edilmesiyle mümkün olabilecektir. Özetle çocukların kendilerine özgü mahkemelerde yargılanabilmeleri ve özgürlüğün kısıtlanmasının son çare olması ve mümkün olan en kısa süre ile sınırlı olmasını sağlamak için aşağıdaki yasal düzenlemelerin yapılması gerekir; a. Bütün çocukların çocuk mahkemelerinde yargılanabilmesi için Terörle Mücadele Kanunu değiştirilmeli ve bütün illerde çocuk mahkemelerinin ve çocuk ağır ceza mahkemelerinin kuruluşu tamamlanmalıdır. b. Çocuklar için hapis cezasının son çare olması ve önceliğin çocuğun yararına verilebilmesi için, Türk Ceza Kanunun cezaya alternatiflerin uygulanmasını engelleyen hükmü (31.md.) değişmeli ve çok suçta tek sorumluluk ilesi benimsenmelidir. Çocuk mahkemeleri yaygınlaştırılmalı / yaygınlaştırma planı kamuoyu ile paylaşılmalıdır. [2.1] no.lu başlıkta ve Tablo 1’de verilen sayılar göstermektedir ki, yargılanan çocuklardan %0,8’i özel yetkili ağır ceza mahkemesinde yargılanmaktadır. Ancak %45 gibi önemli bir kısmı ise genel mahkemelerde yargılanmaktadır. Bu da göstermektedir ki, Terörle Mücadele Kanunu’nda değişiklik yapılsa ve çocukların çocuk mahkemelerinde yargılanmaları kuralı benimsenmiş olsa bile, bütün illerde çocuk mahkemesi ve çocuk ağır ceza mahkemesi kurulmadıkça çocukların çocuk mahkemelerinde yargılanması sonucuna ulaşılamayacaktır. Örneğin, çok sayıda çocuğun bu tür davalara maruz kaldığı illerden biri olan Adana’da çocuk ağır ceza mahkemesi bulunmamaktadır. Bu nedenle aynı zamanda bütün illerde çocuk mahkemeleri ve çocuk ağır ceza mahkemelerinin kuruluşu da talep edilmelidir. Bunun yanı sıra hükümet, çocuk mahkemelerinin yaygınlaştırma stratejisi ve bir eylem planı hazırlama konusunda desteklenmelidir. [35] ÖNERİ 3 Uygulamaların çocuğun ihtiyaçları ve çocuk adalet sisteminin temel prensiplerine uygun olarak yapılması sağlanmalı ve çocuklarla ilgili işlemlerde hukuka aykırılıklarla mücadele edilebilmelidir. [36] Yapılan görüşmelerde sorunun çözümünde, kamu görevlilerinin yasalara uygun hareket etmesinin çok önemli bir rol oynayacağı dile getirilmiştir. Çocuklara özgü usullerin uygulanmasının, çocukların bu gösterilere katılma sebeplerini anlamaya çalışan bir yaklaşım ve şefkatli bir tutumun önemi sıklıkla vurgulanmıştır. Pek çok kişi kanunların ve uygulamaların çocuğa özgü olmasının onları suça teşvik etmeyeceği, aksine kurallara uygun hareket etmeye teşvik edici olacağı görüşündedir. Bu görüşe örnek olarak da polisle top oynayan çocukların daha sonra gösterdikleri tutum gösterilmektedir. Kamu gücü kullananların yasaya uygun hareket etmesi, bütün bunlardan bağımsız olarak insan haklarının ve çocuk haklarının korunmasının asli unsurlarından biri olduğu için de vazgeçilemeyecek bir taleptir. Uygulamada, kolluk tarafından aile ziyaretleri ve okullarda bilgilendirme yapılması, çocukların RAM’lara yönlendirilmesi gibi bu amaca yönelik çabaların da bulunduğu görülmekte ancak bunların güçlendirilmesi gerektiği düşünülmektedir. Bazı uygulamaların bireysel tutumlardan kaynaklandığı dikkate alınarak, hassas noktalarda görev verilecek insanların, toplum psikolojisini ve sorunları bilen, çözüm üretebilen, şefkatle yaklaşabilecek kişilerden seçilmesi de öneriler arasında yer almaktadır. Gerek olaylar sonrasında gözaltına alma aşamasında kolluk kuvvetlerine ait araçlarda, gerekse gözaltı birimlerinde, nakil araçlarında, tutukevinde işkence ve kötü muamele yapıldığına ilişkin iddialar ile kelepçe takma uygulamalarına ilişkin iddiaların ciddiyetle incelenmesi ve faillerine yaptırım uygulanması, bu sorunla mücadele açısından önemli bir unsur olarak kabul edilmektedir. Duruşma nakil araçlarında çocukların yetişkinlerle birlikte bulunmaları, uzun süre duruşma beklemeleri, bu süre zarfında aç kalmaları, havalandırma ve diğer ihtiyaçları bakımından uygun olmayan ortamlarda bekletilmeleri ciddi olarak incelenmesi gereken hak ihlalleri iddiaları arasında yer almaktadır. Bu çerçevede uygulamada aşağıdaki kurallara uygun davranılmasının sağlanması talep edilmektedir; • Çocuklara müdahale edecek polisler çocuk şube müdürlüğüne bağlı birimlerden seçilmeli, • Çocukların yakalamadan sonra önce TEM veya genel kolluk birimlerine götürülmeden çocuk şube müdürlüğüne götürülmesi ve derhal cumhuriyet savcısı önüne çıkarılmaları sağlanmalı, • Gözaltına alınan çocukların ailelerine derhal haber verilmesi, uzmanlardan destek almaları ve avukatlarıyla derhal görüştürülmeleri sağlanmalı, • Avukatlara soruşturma aşamasında dosya inceleme yetkisi verilmeli, • Tutuklama yerine adli kontrol uygulamalarına öncelik verilmeli ve bunun için uygun adli kontrol hizmetleri sağlanmalı, • İddianamelerin okula gönderilmesi gibi eğitim hakkına zarar verici uygulamalar izlenmeli, [37] • Çocukların tutukevinde yetişkinlerle birlikte tutulmaları ve duruşmalara yetişkinlerle birlikte sevk edilmeleri engellenmeli, • Duruşma bekleyen çocuklar için uygun bekleme yerleri tahsis edilmeli ve bu süre içerisinde temel ihtiyaçlarının karşılanması sağlanmalı, • Bu süreçte yasaya uygun hareket edildiğinden emin olunmasını sağlamak üzere etkili bir izleme ve denetim mekanizması geliştirilmelidir. [38] Kamu gücü kullananların yasalara uygun hareket etmelerini sağlamak üzere yapılacak izleme değerlendirmeye sivil toplumun katılımını sağlamak üzere il ve ilçe insan hakları kurulları ile ortak bir çalışma yapılması düşünülebilir. Bu çerçevede, izleme için temel oluşturacak göstergeleri belirlemek üzere bir çalışma yapılması da yararlı olacaktır. ÖNERİ 4 Çocukların eğlenme, dinlenme, boş zamanlarını değerlendirme, spor yapma gibi ihtiyaçlarını karşılayacak hizmetler sunulmalıdır. Çocukların bu eylemlere katılma biçimleri konuşulurken, sıklıkla çocukların bunu bir oyun gibi algıladıkları ve zaten başkaca bir oyun oynama veya boş zaman değerlendirme olanaklarının bulunmadığı dile getirilmiştir. Buna ek olarak da çocukların genellikle zamanlarını sokakta geçirdikleri, bu nedenle de sokakta gerçekleşen eylemin içinde olmalarının kaçınılmaz olduğu da sıklıkla ileri sürülen görüşler arasındadır. Yerel yönetimler, merkezi yönetimin il müdürlükleri ve sivil toplum örgütleri arasında sağlanacak işbirlikleri ile çocuk- lar için spor ve kültürel faaliyet alanlarının yapılmasının önemi herkes tarafından vurgulanmaktadır. GAP Eylem Planı’nın, genel olarak bölgesel kalkınma odaklı olması bakımından özellikle Diyarbakır’da kamu kurumlarında bu alanda yeni projeler yapılmasını teşvik ettiği gözlenmektedir. Proje kapsamında yürütülecek çalışmaların başlıca hedefleri şöyle belirlenmiştir: 1. Okulöncesi eğitimde %50, zorunlu eğitimde %100, ortaöğretimde %90 okullaşma oranına ulaşılacaktır, 2. Yükseköğretimde beşeri ve fiziki kalitenin artırılması, öğretim elemanı başına düşen öğrenci sayısının ülke ortalamasına yaklaştırılması, öğretim elemanı sayısının ve yurt kapasitesinin arttırılması, 3. İşgücü eğitim programları ve mesleki danışmanlık ve rehberlik hizmetlerinin yaygınlaştırılması, valiliklerin bu hizmetlerdeki rolünün arttırılması ve il özel idarelerinin bütçelerine ek kaynak sağlanması, 4. Sağlık hizmetlerinde beşeri ve fiziki alt yapının güçlendirilmesi (örn. 10,000 kişiye düşen yatak sayısının 20’ye yükseltilmesi), aile hekimliği uygulamasının yaygınlaştırılması. Projede her ilde, Çocuk ve Gençlik Merkezi, Sevgi Evleri ve Bakım ve Sosyal Rehabilitasyon Merkezi kurulması öngörülmüştür. Çocuk Okuma Odaları ve Gençlik ve Kültür Evlerinin güçlendirilmesi ve kurumsallaştırılması ve her ilde Gençlik Merkezi kurulması planlanmaktadır. Özellikle göçle gelen kesimler olmak üzere kentlerin az gelişmiş bölgelerinde yaşayanların kente entegrasyonu ve toplumsal uyumunu sağlamaya yönelik olarak Toplum Merkezleri [39] (TM) ve Aile Danışma Merkezlerinin (ADM) yeni bir yapılanmayla daha etkin ve nitelikli hizmet sunan bir yapıya kavuşturulması hedeflenmektedir. TM ve ADM’lerin nüfus oranları ve göç durumu dikkate alınarak sayılarının arttırılması ve faaliyetlerinin çeşitlendirilmesi, burada çalışan personel sayısı ve niteliğinin artırılması planlanmaktadır. [40] Ancak eylem planının; kültürel ve sportif faaliyetlerin il ve ilçelerde birer tesis kurma biçiminde öngörülmesi, toplum merkezlerinin çok sınırlı sayıda planlanmış olması, kısacası bu faaliyetlerin çocuklar ve dezavantajlı durumdaki kadınlar bakımından kolay ulaşılabilir nitelikte olmaması, tam anlamıyla ilde duyulan ihtiyaca yanıt verilebileceğine yönelik kaygı duyulmasına neden olmaktadır. Öte yandan GAP Eylem Planı, Hakkari gibi pek çok ili de kapsamamaktadır. Bu nedenle bu alanda yapılacak çalışmaların başında, ildeki ilgili kuruluşlar arasında işbirliklerinin güçlendirilmesi ve il yöneticilerinin çocuklar ve gençlerin yararlanabilecekleri sosyal ve kültürel hizmetleri yaygınlaştırmak konusunda desteklenmeleri gelmelidir. Bunun için il düzeyinde çalıştaylar ve yerel projeler yapılması düşünülebilir. Bu sorunun çözümünde önemli bir katkı sağlayacak olan bu tür hizmetlerin bütün çocukların yararlanabilecekleri biçimde sunulması, sorunu çözmenin bir aracı olmasının ötesinde çocuklar için çok önemli bir hakkın gereğinin yerine getirilmesidir. Bu nedenle de, bu konunun üzerinde ciddiyetle durulması gerekir. Bir görüşmecinin ifadesi bu yaklaşımı açıklar niteliktedir: “Göç edenlerin yerleştikleri mahallelere, çocuklar için al- ternatif hizmetler götürülmeli, onların bazı hizmetlerden yararlanmak için bir yerlere gelmesi beklenmemeli. Bu yöntem denendi ve işlemediği görüldü. Kamu kurumlarının halkın bulunduğu yerde hizmet sunuyor olması gerekir.” Bu yaklaşım hem bölgede yaşayan herkes tarafından hem de merkezi yönetimde yer alan kişiler tarafından da desteklenmektedir.2 Aynı zamanda da çocukların ihtiyaçlarını karşılamaya yönelik faaliyetlere yatırım yapılması, bu sorunun çözümüne ilişkin talepler arasında yer almaktadır: Eğitimin kaliteli ve parasız olması, çocuk ihtiyaçlarına yönelik hizmetler için bütçenin ve uzman sayısının arttırılması gibi. ÖNERİ 5 Sorunun siyasi, sosyal ve ekonomik boyutu fark edilmeli ve siyasi, sosyal ve ekonomik çözümler üzerinde çalışılmalıdır. Bütün bu söylenenler ile birlikte konunun siyasal, sosyal ve ekonomik yönünün de ihmal edilmemesi gerekir. Çocukların sürekli şiddet uygulanan bir ortamda büyümeleri ve bu durumda da tepkilerini şiddet içeren bir biçimde dile getirmesini önlemenin zorluğuna dikkat çekilmektedir. Görüşülenlerin üzerinde birleştikleri tespitlerden biri, çocukların yaşadıkları sosyal çevrenin ekonomik ve sosyal yönden yoksunlukları olmuştur. Örneğin, Adana’da 20,000 tuvaleti olmayan ev bulunduğu, 90,000 evin tuvaletinin ise bahçede olduğu bildirilmiştir. 2 TBMM İnsan Hakları Komisyonu Başkanı Zafer Üskül’ün açıklaması, Radikal Gazetesi 4.12.2008 [41] 2008 Mayıs ayında yayınlanan GAP Eylem Planı’nın, Diyarbakır’da bu bakış açısı ile hazırlanan çalışmalara hem motivasyon hem de kaynak sağlamakta olduğu görülmektedir. Gerek Diyarbakır Valiliği, gerekse Sosyal Hizmetler ve Çocuk Esirgeme Kurumu, yapılması planlanan aktivitelerin GAP Eylem Planı çerçevesinde desteklenmesini beklemektedir. Eylem Planı, Türkiye nüfusunun %10’unu içeren 9 ili kapsamaktadır (Adıyaman, Diyarbakır, Mardin, Batman, Gaziantep, Kilis, Şırnak, Siirt, Şanlıurfa). Planın hedefi, bölge ortalamalarını yıllık gelir, istihdam, eğitim gibi alanlarda Türkiye ortalamasına yükseltmek olarak ifade edilmektedir. 2008 – 2012 yıllarını kapsayan Planda, sosyal gelişimin desteklenmesine yönelik faaliyetlere 2,698,152,000 TL ayrılmış bulunmaktadır. [42] Ancak, TESEV tarafından hazırlanan “Kürt Sorununun Çözümüne Dair Bir Yol Haritası: Bölgeden Hükümete Öneriler” (2008) başlıklı raporda GAP Eylem Planı’nın gerek kapsamı gerekse hazırlık yöntemi nedeniyle, bölge halkı tarafından Kürt Sorunu’nun çözümüne dönük bir politika olarak algılanmadığı ileri sürülmektedir. Plan, bölge halkının açlık, barınma gibi günlük ve ertelenemez sorunlarına ilişkin bir çözüm önermemesi, bölgedeki adaletsiz toprak dağılımı, zorunlu göç, koruculuk, mevsimlik göç, köye geri dönüş konularına hemen hiç değinmemesi nedeniyle eleştirilmektedir. Raporda, GAP Eylem Planı’nın olağanüstü hal uygulanmış bulunan bütün illeri kapsaması önerilmektedir. Bu nedenlerle, raporun GAP İdaresi ile paylaşılması ve İdarenin bundan sonra yapılacak çalışmalara katılımının sağlanması da yararlı olabilir. Kaynak: Radikal Gazetesi 07.04.2009 Çocukların bu tür olayların içinde bulunmalarının nedenleri ve bu sebeple zarar görmelerini engellemek üzere kullanılabilecek yöntemler tartışılırken bölgede yaşanan siyasi, sosyal ve ekonomik sorunların çocuklar üzerindeki olumsuz etkisini görünür kılmaya ihtiyaç bulunmaktadır. Bölgede yaşanan sorunların çocukları nasıl etkilediğini görmek ve bunu engellemenin yollarını araştırmak üzere bir çalışma başlatılması, örneğin bir arama konferansı düzenlenmesi kamu kurumları ve sivil toplum kuruluşları tarafından önerilmektedir. Çocuğun toplantı ve gösteri düzenleme ve ÖNERİ 6 katılma hakkı ve risklerden korunmasına yönelik önlemler konusunda duyarlılık arttırılmalıdır. Bu konu çalışılırken sorunun arka planını oluşturan bazı farklı bakış açılarını da dikkate almak gerekmektedir. Çocukların bir gösteriye katılıyor olma halinin bizzat kendisi, bu eylemin nedeni ve niteliğine bakılmaksızın tehlike olarak algılanmaktadır. Buna bir de terörle mücadele bakış açısı eklendiğinde çocuklar kolaylıkla terör suçlusu olarak [43] adlandırılabilmektedir. Bu nedenle, bakış açıları ve tutumlar üzerinde çalışmadan, sadece yasa değiştirmekle sorunu çözmek mümkün görünmemektedir. Yapılan görüşmelerde uygulamacıların genellikle kendileri ile ilgili işlemlerden sonra, çocukların başına gelenden haberdar olmadıkları gözlemlenmiştir. Bazıları hiç ceza verilmediğini düşünürken, bazıları yüksek cezalar verildiğini basından okuduklarını, ancak bunun gerçeği yansıtmadığını belirtmişlerdir. Bu nedenle çocukların bu süreçte yaşadıklarının ve bunların çocuklar üzerindeki etkisini görünür kılacak bir çalışma yapılması yararlı olacaktır. [44] Çocukların görüşlerini ifade etme, toplantıya veya gösteriye katılma hakları B.M. Çocuk Haklarına Dair Sözleşmesi’nin 14. maddesi ile güvence altına alınmıştır. Çocukların içinde bulunduğu toplumun yaşam koşullarından etkilenmemesi de düşünülemez. Bu nedenle çocukların bu sorunları şiddet içermeyen bir biçimde ifade etme ve tepki göstermelerinin bir hakkın kullanılması olduğunun kabulü de gerekmektedir. Öte yandan gösterilerin şiddet içerir hale gelmesi durumunda, çocukların zarar görme ihtimaline karşı korunmaları da onların hakları gereğidir. Ancak toplumun önemli bir kesimi, protesto, tepki gösterme gibi eylemleri hiçbir biçimde çocuklara özgü davranışlar arasında görmezken, bir diğer kesim ise tehlike altında olma riskine rağmen çocuğun sorunun çözümü mücadelesinin bir parçası olmasını kaçınılmaz kabul etmektedir. Çocuğun her iki tutuma karşı korunmasını ifade eden şu görüş, toplumda bu konuda geliştirilmesi gereken anlayışı da özetlemektedir: “Çocukların ön planda kullanılması da yanlış, bazı kamu görevlilerinin kendilerini devletle öz- deşleştirerek verdiği aşırı tepki de. Çocuklar örgütle devlet arasına sıkışmış ve bunların siyasetinin malzemesi olmuş durumda. Çocukların her iki yaklaşımdan da korunması gerekir.” Özellikle kanun uygulayıcılar, çocukların gösteri yapma hakkı konusunda oldukça kısıtlayıcı bir tutum sergilemekte, örneğin kabul edilebilir nitelikte protesto eylemi örneği verememektedirler. Bu nedenle üzerinde çalışılması gereken önemli konulardan biri; çocukların ifade, gösteri ve yürüyüş haklarının toplumca kabul edilir hale gelmesi ve çocuklara bu haklarını kullanmalarını sağlayacak elverişli yolların gösterilmesidir. Aynı zamanda ve bununla bağlantılı olarak, çocukların güvenliklerinin tehlike altında olduğu durumlarda, gösteri alanından çocuğun uzaklaştırılması ve çocuğun güvenliğini sağlayacak önlemlerin alınması konusunda da bir toplumsal duyarlılık yaratılmasına, bütün yetişkinlerin üzerinde hem fikir oldukları bir tutumun benimsenmesine ihtiyaç bulunmaktadır. Benzer bir biçimde bu konuda da çalışma yapılması gerekmektedir. Görüşmecilerden bir kısmı sivil toplum kuruluşları ve DTP’nin bu konudaki tutumunun etkili olacağı görüşündedir. Aynı zamanda toplumdaki kanaat önderleri ve aileler ziyaret edilerek gençlerin şiddet içeren gösterilerden korunmalarını sağlamak konusunda desteklerinin alınmasının da yararlı olacağı belirtilmiştir. Bu konu üzerinde çalışılması, çocukluk kavramının toplum nezdinde tamamen anlamını kaybetmesini önlemek bakımından da önemlidir. Çünkü 2008 yılı sonlarından bu yana, polisin yanına durarak karşı taraftaki çocuklara taş atan çocuk görüntüleri de basında yayınlanmaya başlamıştır. Bu da, çocukların bir kavga içerisine sürüklenmesi [45] Kaynak: Radikal Gazetesi 20.04.2009 ve onları korumakla görevli kimselerin bunu teşvik etmeleri veya seyirci kalmaları gibi çok riskli bir durum yaratmaktadır. Aynı zamanda olaylara katılan çocukların yaşlarının çok küçülmekte olduğu görülmektedir. [46] Tutum değişikliğinde merkezi otoritenin tavrının çok önemli olduğu da hem ifade edilmiş hem de gözlenmiştir. Örneğin 21 Mart’ın bayram ilan edilmesi ve kutlamalara izin verilmesi sonrasında müdahalenin yumuşadığı dile getirilmiştir. Kanun değişikliği ve gerekli alt yapının hazırlanması zaman alacak olmakla birlikte, bu konudaki irade değişikliğini gösterecek politikacı ve yönetici tutumları, diğer ihtiyaçlar karşılanıncaya kadar çocukların bu olaylar sonucu zarar görmesini engellemekte etkili olacaktır. Bu nedenle çocuğun ifade özgürlüğü ve korunma hakkı çerçevesinde konuya yaklaşılmasını sağlayacak yeni politikaların geliştirilmesi ve yöneticilerin bunu destekleyecek tutum ve davranışları üzerinde çalışılmasına ihtiyaç bulunmaktadır. Basının bu konuyu ele alış biçimi de önemli bir sorun alanı olarak görülmekte ve medyada haberlerin yer alış biçiminin kanunun uygulayıcıların tavrını sertleştirdiği iddia olun- maktadır. Bu nedenle, yapılacak çalışmalarda bir hedef grup da medya olmalıdır. ÖNERİ 7 Uygulamaların izlenebilmesi ve gerekli politikaların zamanında oluşturulabilmesi için veri toplama ve değerlendirme sistemi güçlendirilmelidir. Gerek görüşmelerde, gerekse raporun hazırlanması sırasında incelenen resmi istatistiklerde, çocukların durumunu anlamaya yarayacak güncel ve yeterli sayısal verinin bulunmadığı görülmüştür. Örneğin, tutuklu çocukların suç tiplerine göre sınıflandırmaları ve tutukluluk süreleri gibi veriler yayınlanan istatistiklerde yer almamaktadır. Bu da sorunun boyutunu güncel veriler ile anlamayı, dolayısıyla çocukların ihtiyaçlarına uygun biçimde ve zamanda doğru politikalar ile hizmet sunmayı güçleştirmektedir. Çocuklar için adaletin iyi ve doğru işleyebilmesi, verilerin ihtiyaca uygun biçimde toplanmasına bağlı bulunduğundan bu çerçevede yapılması gerekenlerden biri de; İçişleri Bakanlığı, Adalet Bakanlığı ve TUİK ile ortak bir çalışma başlatmaktır. Hence, there is a need to develop new policies that will ensure an approach that is in line with the rights of the child to expression and protection, and to work on the supportive attitudes and behaviour to be adopted by administrators. The way this matter is handled in the media is also seen as a problem area, and it is claimed that the manner in which these events appear in the media hardens the attitude of the law enforcement authorities. Therefore, the media should be one of the target groups in future activities. SUGGESTION 7 The data collection and evaluation system must be strengthened for timely monitoring of the implementation and development of necessary policies. Both during the interviews and in the examination of official statistics during the drafting of the report, it was seen that there are not enough up-to-date quantitative data to help in understanding the situation of the children. The published statistics do not, for example, classify arrested children by crime, duration of arrest etc. This in turn makes it difficult to understand the scale of the problem via up-to-date data and hence to promptly provide services and policies appropriate for the needs of the child. Since good and accurate administration of justice for children is dependent on data collected in accordance with requirements, one thing that needs to be done in this framework is to launch a joint study with the Ministry of Interior, Ministry of Justice and TURKSTAT. support in protecting young people from violent demonstrations would be beneficial. Source: Police Gazette 20.04.2009 Working on this matter is also of major importance in terms of preventing the concept of “childhood” from losing its meaning entirely in the eyes of the society. As such, since late 2008, images of children standing by police officers and throwing stones at the children on the other side have also started to appear in the media. This creates a highly risky situation where children can be dragged into a fight and where people tasked with protecting them can encourage such a fight or simply chose to stand by and watch. Furthermore, it is seen that the children participating in demonstrations are gradually getting younger. [49] It was also expressed and observed that the attitude of the central government is very important in achieving a change in attitudes. For example, it was expressed that the interventions softened with the declaration of 21 March as a national holiday and the authorization of celebrations. Although the law amendments and the preparation of the necessary infrastructure will take time, the attitudes [48] utable to children, another segment inevitably acknowledges these acts as a part of the child’s struggle to solve his/her problems despite the risk of danger. The following view which advocates the protection of the child against both attitudes also sums up the understanding that needs to be developed in society: “It is wrong to use children in the front line, and the way in which some public officials excessively react, identifying themselves with the State, is also wrong. Children are stuck between the terrorist organization and the State and have already become a tool in their politics. Children should be protected from both sides.” Law enforcers in particular demonstrate a somewhat restrictive attitude towards the right of the child to demonstrate; for example, these people cannot give even one example of a protest that they think is acceptable in nature. Therefore, one issue that requires due attention is to ensure that the right of the child to express his or her views and to take part in demonstrations and marches becomes acceptable in society, and to show children appropriate and convenient ways through which they can exercise these rights. At the same time and in connection with the above, there is a need to raise social awareness on the measures to be taken to remove the child from the demonstration area and ensure his/her safety when the safety of children is in danger, and to adopt an attitude on which all adults can reach a consensus. Similarly, there is a need to work on this issue too. Some of the interviewees are of the opinion that the attitudes of NGOs and the DTP on this matter are likely to be effective. Also, it was indicated that visiting the communities’ opinion leaders and families to secure their When working on this issue, it is necessary to take into account some distinctive viewpoints that form the background of the problem. On its own, the participation of children in demonstrations is perceived as a danger without considering the nature and cause of this act. When an anti-terrorist viewpoint is added to this perception, children can easily be identified as terrorist criminals. Hence, it does not seem possible to solve the problem merely with law amendments, without working on perspectives and attitudes. In the interviews, it was observed that law enforcement personnel were generally not aware of what happened to the children after the procedures which involved them. Some thought the children did not receive any punishments, while some stated that they had heard from the media that the children were sentenced to heavy penalties but that this did not reflect the truth. Therefore, it would be useful to launch an activity to increase the visibility of what these children go through during the process and the impact of these experiences on them. [47] The right of the child to express his views and take part in assemblies and demonstrations is guaranteed under Article 14 of the UN Convention on the Rights of the Child. It cannot be conceived that children will remain unaffected by the living conditions of the community in which they live. Hence, it should be acknowledged that for children to express these problems and react to them in a non-violent way is an exercise of their rights. On the other hand, it is also the right of the child to be protected from potential harm in cases where demonstrations become violent. However, while a significant segment of the society does not see acts of protesting or reacting as behaviour attrib- [46] seasonal emigration, and the return to villages. The report suggests that the GAP Action Plan should cover all the provinces which were under the state of emergency. Therefore, it might be useful to share the report with the GAP Administration and ensure the Administration’s participation in future activities. Source: Police Gazette 07.04.2009 There is a need to ensure visibility of the adverse effects of the political, social and economic problems of the region on children when discussing the reasons why children are involved in such events and ways of protecting them from any damage. Public agencies and NGOs suggest launching a scheme to see how the problems between adults affect children and investigating ways of preventing this effect on children, for instance by organizing an exploration conference. SUGGESTION 6 Sensitivity and awareness should be raised with regard to the right of the child to organize and take part in meetings and demonstrations and to be protected from risks. One point on which all interviewees agreed was the economic and social deprivation of the social environment in which children live. For example, it was reported that in Adana there are 20,000 residences with no toilet facilities, and 90,000 residences with toilets outside in their yards. It is seen that the GAP Action Plan published in May 2008 acts as both a source of motivation and as a resource for activities designed from this viewpoint in Diyarbakir. Both the Provincial Governorate of Diyarbakir and the Social Services and Child Protection Agency (SHÇEK) expect that the planned activities will be supported within the framework of the GAP Action Plan. The Action Plan covers 9 provinces which accommodate 10% of the Turkish population (Adıyaman, Diyarbakır, Mardin, Batman, Gaziantep, Kilis, Şırnak, Siirt, Şanlıurfa). The aim of the plan is identified as increasing the regional averages to Turkish averages in areas such as annual income, employment and education. The Plan for the 2008–2012 period sets aside TL2,698,152,000 for activities that support social development. [45] However, in the report “A Roadmap for the Solution of the Kurdish Question: Suggestions to the Government from the Region” (2008) prepared by TESEV it is suggested that the GAP Action Plan is not perceived as a policy oriented to solve the Kurdish Question by the people of the region either in terms of its scope or in terms of the manner of its preparation. The Plan is criticized for not providing any solution to the daily and unpostponable problems of the local people such as hunger and shelter, and for making almost no mention of issues such as the unfair land distribution in the region, forced emigration, village guards, [44] A statement by one of the interviewees is quite clarifying with regard to this approach: “Alternative services oriented to children should be brought to neighbourhoods where immigrants live; authorities should not wait for these people to go somewhere else to be able to make use of such services. This was tried before and it was seen that the method just doesn’t work. Public agencies should be providing their services where the people are located.” This approach is supported not only by all residents of the region but also by those working in central government2. At the same time, demands made for the solution of the problem include investment in activities oriented to meet the needs of children such as quality and free education, and an increase in the number of experts and the budget for services oriented to the needs of children etc. SUGGESTION 5 Political, social and economic dimensions of the problem should be recognized, and efforts should be focused on political, social and economic solutions. In addition to all that has been said thus far, the political, social and economic aspects of the matter should not be overlooked. It is pointed out that it will be very difficult to prevent children who grow up in an environment of constant violence from expressing their reactions with violence. 2 Statement by Zafer Üskül, Chairman of the Parliamentary Human Rights Commission of the TGNA, Radikal, 4.12.2008 tres (TM) and Family Consultation Centres (ADM) so as to render their services more effective and higher in quality. It is also planned to increase the number of TMs and ADMs in view of the population and migration status, and to diversify their activities as well as to boost the number and quality of the personnel working in these centres. However, there is concern that the action plan will not be able to fully meet the needs of the provinces, since the cultural and sports-related activities foreseen are limited to establishing one facility per province and district, and community centres are also planned in a very limited number and hence are not easily accessible by children and disadvantaged women. Moreover, the GAP Action Plan does not cover many of the provinces in the region, such as Hakkari. [43] Therefore, the first thing to be done in this area should be to strengthen cooperation between the relevant agencies in the provinces, and to support provincial administrators in making social and cultural services widely available for children and young people. The possibility of carrying out local projects and workshops to this end at the provincial level may be considered. Offering these services, which are likely to make a huge contribution in the solution of this problem, in a way that will enable all children to benefit from them will not only serve as a means of solving the problem but will also mean the fulfilment of a very important requirement with regard to the rights of the child. Therefore, serious emphasis should be given to this matter. [42] The main objectives of the activities to be carried out under the Project are identified as follows: 1. Achieving a schooling rate of 50% in preschool education, 100% in compulsory education and 90% in secondary education, 2. Increasing the human and physical quality in higher education, approximating the number of instructors per student to national average, increasing the number of instructors and the capacity of dormitories, 3. Spreading labour training programs and vocational consultation and guidance services, increasing the role of provincial governorates in these services and securing additional resources for the budgets of provincial private administrations, 4. Strengthening the human resources and physical infrastructure in health services (e.g. increasing the number of beds per 10,000 people to 20) and expansion of the family medicine system. The Project foresees the establishment of Child and Youth Centres, Child Homes and Care and Social Rehabilitation Centres in all project provinces. It is also planned to reinforce and institutionalize Child Reading Halls and Youth and Culture Homes, and to set up Youth Centres in all project provinces. In order to ensure urban integration and social cohesion and adaptation of those living in underdeveloped sections of the city, especially of immigrants, it is aimed to introduce a new structure for Community Cen- In order to make sure that civil society takes part in the monitoring and assessment activities to be carried out to ensure adherence to the law by those exercising public authority, the possibility of working jointly with provincial and district human rights committees can be considered. In this framework, it would be useful to do a preliminary study to identify the indicators that will form the basis for such monitoring. Services that will fulfil the entertainSUGGESTION 4 ment, leisure, rest and sports requirements of children should be provided. When talking about the manner in which children participate in these demonstrations, it was expressed that children frequently perceive such demonstrations as a game and that in any case they do not have any other opportunities to play or spend their leisure time. In addition, it was also pointed out frequently that children generally spend their time on the streets, and therefore their involvement in the demonstrations that take place on the streets is somewhat inevitable. [41] The importance of setting up venues and facilities for culture and sports activities oriented to children via cooperation between local governments, provincial directorates of central government and non-governmental organizations is emphasized by all. It is observed that the GAP (South-eastern Anatolia Project) Action Plan encourages new projects by public agencies in this area, especially in Diyarbakir, since it is focused in general on regional development. [40] • The members of the police who are to deal with children should be selected from units attached to the child division, • It should be ensured that children are brought straight to the child division following their apprehension, without being taken to TEM or general law enforcement units, and immediately brought before a public prosecutor, • Families of children taken into custody should be informed immediately, and it should be ensured that the family gets support from experts and secures the services of an attorney immediately, • Attorneys should be authorized to examine the files during the investigation phase, • Judicial control practices should have priority over arrests, and appropriate judicial control services should be provided to this end, • Practices that compromise the right to education, such as sending indictments to the child’s school, should be monitored, • It should be ensured that children are not held together with adults in prisons and are not transferred with adults when being taken to their hearings, • Appropriate waiting areas should be assigned to children waiting for their hearings, and it should be ensured that their basic needs are met during the waiting period, • An effective monitoring and supervision mechanism should be developed to make sure that everything is in accordance with the laws during this process. In practice, it is seen that there are efforts to this end, such as visits by law enforcement authorities to families and information seminars at schools or steering children to counselling centers, yet it is thought that these efforts should be strengthened. Keeping in mind that some practices stem from individual attitudes, it is suggested that those who are to be appointed to sensitive posts are selected from among individuals who have a good understanding of social psychology and knowledge of social problems, and who are able to produce solutions and adopt a compassionate approach. Claims of torture and ill-treatment by law enforcers during events or during the detention phase following the events, in law enforcement vehicles, at detention centres, in transfer vehicles or in prisons, and claims regarding the prac- [39] tice of using handcuffs should be seriously investigated, and sanctions should be imposed on the perpetrators. All of these are considered to be an important element in combating the problem at hand. Other allegations of serious rights violations which require full investigation include cases of children being held in transfer vehicles together with adults, children having to wait for long hours for their hearings and children being left hungry while waiting in the courthouse under conditions that are not favourable in terms of their fresh air and other needs. In this framework, it is demanded that the following rules are adhered to in implementation: [38] For these reasons, the establishment of juvenile courts and juvenile heavy penal courts in all provinces should also be demanded. At the same time, the government should be supported with regard to preparing a strategy for spreading juvenile courts in all provinces and developing an action plan. SUGGESTION 3 It should be ensured that implementation is always in conformity with the needs of the child and the fundamental principles of the juvenile justice system, and all breaches of law in procedures related to children should be addressed. Those interviewed stated that if public employees abided by the law, this would go a long way towards solving the problem. The importance of implementing procedures specifically applicable to children, adopting an approach which endeavours to understand the reasons why children participate in these demonstrations and having a compassionate attitude was frequently emphasized. A lot of people think that having laws and procedures specifically applicable to children will not provoke them into committing a crime, and in contrast will encourage them to behave in line with applicable rules. One example given to support this opinion is the attitude subsequently observed in the attitudes of children who played football with the police. It is indispensable to demand that those exercising public authority should abide the law, as this is, regardless of all else, one of the essential elements in the protection of human rights and the rights of the child. specifically applicable to them and that deprivation of liberty is used only as a measure of last resort and limited to the shortest time possible, it will be necessary to introduce the following legal arrangements: a. In order to ensure that all children are tried in juvenile courts, the Anti Terror Law should be amended and the establishment of juvenile courts and juvenile heavy penal courts should be completed in all provinces. b. In order to ensure that the penalty of imprisonment for children is a last resort and priority is given to the best interests of the child, the provision of the Turkish Penal Code that inhibits the application of alternative measures (Art. 31) should be amended and the principle of single responsibility for multiple crimes should be adopted. [37] Juvenile courts should be made widespread / the dissemination plan should be shared with the public. The figures given under Section 2.1 and in Table 1 show that 0.8% of all children put to trial are tried in specifically designated heavy penal courts. However, a major portion, 45%, is still tried in general courts. This shows that even if amendments are made in the Anti Terror Law and even if ensuring that children are tried in juvenile courts is adopted as a rule, it will not be possible to reach an outcome where all children are tried in juvenile courts, unless juvenile courts and juvenile heavy penal courts are established in every province. For example, Adana, one of the provinces where a large number of children are exposed to such lawsuits, has no juvenile heavy penal courts. [36] Article 13 of the Anti Terror Law prohibits conversion of a prison penalty into another sanction or the postponement thereof, and is therefore in contradiction with the principle of using measures and penalties that constitute a deprivation of liberty only as a measure of last resort, as enshrined in Article 37 of the UN Convention on the Rights of the Child, and in practice leaves children with no alternative in the face of penal law interventions. Some practitioners also demand amendments to Articles 220 and 314 of the Turkish Penal Code, which cause the participation of children in demonstrations to be penalized as membership of an organization, as well as amendments to Articles 5 and 7 of the Anti Terror Law. In the implementation of these articles, the consequences for the children should be taken into consideration and the alternatives of either introducing an exception lifting their applicability for children or completely redrafting the articles should be discussed. The principle of “single responsibility for multiple offenses” should be adopted for offenses involving children. Meanwhile, children who repeat an act of the same nature more than once are at risk of exposure to very heavy penalties. Preventing this will be possible by adopting the principle of “single responsibility for multiple offenses”, which is one of the most important principles of the juvenile justice system. In sum, in order to ensure that children are tried in courts effect by Turkey, constitutes a part of domestic law. Thus, the right of the child to be tried in courts specifically applicable to them is also protected by the right to “a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law” included in Article 6 of the European Convention on Human Rights (ECHR). Article 141 of the Constitution of the Republic of Turkey also stipulates that “special provisions shall be provided in the law with respect to the trial of minors”. Within the framework of these arrangements, articles 9 and 13 of the Anti Terror Law is in violation of the UN Convention on the Rights of the Child, the European Convention on Human Rights and Article 141 of the Constitution, as they foresee the same courts and same procedures for the trial of children and adults. Articles 9 and 13 of the Anti Terror Law are also under criticism for being in violation of the rule of non-discrimination (CRC Article 2), the principle of equality (Constitution Art. 10), the principle of prioritizing the best interests of the child (CRC Art. 6, CPL Art. 4), the principle of being a state governed by the rule of law (Constitution, Article 2) and the principle that no one may be tried by any judicial authority other than the legally designated court (Constitution Article 37)1. [35] In Guvec vs Turkey, the European Court of Human Rights examined the trial of a 15 year old juvenile by the State Security Court, and determined a violation of Article 6 of the ECHR. 1 Evaluation Report of the Amendment to the Anti-Terror Law in views of Child Rights, Istanbul Bar Association, March – 2007 [34] dren should be put in place since this cannot wait until the other suggestions herein are put into practice fully. One measure that will provide a solution in the short run is to ensure that public authorities adopt a clear attitude on this issue. A meeting should be held with the representatives of responsible institutions, so as to assess the situation, and constant cooperation with the same should be ensured. SUGGESTION 2 Necessary amendments should be made in the laws to ensure that children are tried in juvenile courts with juvenile-specific procedures, and juvenile courts should be made widespread. Both practitioners and relevant experts see the trial and punishment of children participating in demonstrations as if they were adults as a secondary victimization of the child and suggest that necessary legal changes should be made to ensure that children are tried in juvenile courts. To this end, it is necessary to make more than one law amendment, and also to increase the number of juvenile courts and fill the gaps in human resources and infrastructure. Articles 9 and 13 of the Anti-Terror Law should be amended. Article 40 of the Convention on the Rights of the Child accepts it as an element of the right to fair trial to have courts and procedures specifically applicable to children. In accordance with Article 90 of the Constitution, the Convention, which is signed and ratified and thereby put into PART 2 RECOMMENDATIONS This section was prepared taking into consideration the views expressed during the interviews and the written comments and suggestions of non-governmental organizations. SUGGESTION 1 Priority should be on assuring the right of the child to life, and the principle of “zero tolerance” should be adopted to prevent torture and ill-treatment of children. [33] It is seen that interventions during and after demonstrations pose a serious danger to the right of the child to life. This is something which requires attention and measures to be taken without delay. Whatever the demonstrations and the threat they pose may be, the exposure of children to ill-treatment and beatings and to interventions that can cause their death by those exercising the power of the public is unacceptable. This should be the first principle to be adopted by everyone working in this field when carrying out their duties. Although all the other suggestions included in this report are oriented to ensure this result, a short-term action plan to prevent death and injury of chil- [32] One claim is that the participation of children in demonstrations and their engagement in protesting certain events is perceived by law enforcement authorities as an assault on the State and, by identification, on the law enforcement authority itself, which leads law enforcement authorities to show no tolerance towards such acts. The impunity of public employees who commit crimes against children is cited as evidence for this view. Also the Report on Perception and Mentality Patterns in the Judiciary prepared by TESEV as a result of a survey carried out in 2007 is used to support this viewpoint. In this survey conducted on 51 judges and prosecutors using the in-depth interview technique, the question “Can human rights pose a threat to state security?” received an affirmative reply (“yes”) from 51% of the respondents, while only 28% of the respondents replied “No”. The question “Can we say there is a tendency to differentiate in the approach of the judiciary to offenses committed against the state and offences committed by civil servants?” was replied as “unfortunately, yes” by 45% of the respondents, and “yes, and there should be” by 24% of the respondents. Moreover, it is claimed that barring a few provinces including Diyarbakir and Adana, authorities cannot prevent children staying in custodial institutions from being in contact with adults, and that in some provinces juveniles even stay in the same wards as adults. on violation of TCC, 16.2% were convictions, 8.6% were acquittals and 75% were in the “other” category; while in 2007 33% were convictions, 13.2% were acquittals and 53% were under the “other” category. The disaggregated data as per the number of cases decided and the types of decisions ruled is given in Table 4. As can be seen here, while there is a decrease in the number of suits filed against juveniles compared to adults, there is an increase in the number of suits resulting in conviction. The percentage of convictions ruled for the offence of violating the TCC rose from 16.2% to 33% for adults, translating into a two-fold increase. For children, the percentage rose from 4.7% to 47%, corresponding to a tenfold increase. With regard to other crimes, no big difference is observed in the juvenile/ adult ratio. Suits were filed under TPC Art. 314 against 2,860 adults and 198 juveniles in 2006, with a juvenile/ adult ratio of 6.9%; in 2007, this ratio was 6.5%. In 2006, suits were filed under TPC Art. 220 against 8,167 adults and 215 juveniles, with a juvenile/adult ratio of 2.6%. In 2007, these figures were 8,921/207 respectively, with the juvenile/adult ratio down to 2.3%. While the number of children against whom action was brought increased in 2006 – 2007, there is a decrease in the number of children whose files were decided. When the court rulings are examined, it is seen that there is a decrease in the number of decisions other than conviction and acquittal, such as postponement etc, whereas there is an increase in the number of conviction and acquittal decisions. For example, of the 335 children put to trial in 2006 on charges of violation of the TCC, 2.99% received convictions, 4.3% acquittals and 89.85% other rulings; whereas for 2007 these figures are as follows: 47% convictions, 18.53% acquittals, 33.3% other rulings. In order to understand the change in the decision trends of the courts, it may be fruitful to look at the decisions ruled for adults in the same years. In 2006, a total of 3,683 court decisions were ruled against adults for violation of the Anti-Terror Law, 599 of which were convictions, 317 of which were acquittals and 2,767 of which were under the “other” category. In 2007, the total number of court rulings was 4,536; and 1,505 of them were convictions, 600 acquittals, and 2,431 in the “other” category. The ratio of rulings concerning adults within the years to the total number of rulings varied as follows: of the overall rulings in cases who attended school prior to their arrest find their ties with their schools weakened or altogether broken after their release following a long period in custody. It was also reported that sometimes the courts send the indictments to schools with a request for disciplinary inquiry. Separately, it is reported that 4 juveniles named S.K., A.Y., M.K. and F.E. were taken into custody during demonstrations taking place in Tarsus on 29.10.2008 and were still under arrest as of March 2009 when the report was being drafted, and had not been brought before a judge in the last 6 months. Since Prison Statistics do not include data on children disaggregated by crime, age and status as detainee or convict, it is not possible to make an assessment on children placed under arrest due to these crimes. [29] However, it is possible to make an assessment of the penalization trend based on the number of actions filed and decisions ruled by courts. It is seen that although there is an increase, compared to adults, in the number of children taken into custody, the same tendency is not observed with regard to the number of actions filed. For the year of 2006, the number of adults concerning whom action was filed on claims of violation of the Anti-Terror Law is 3,708 whereas the same for juveniles is 299. For the same year, the ratio of children against whom a suit was filed on violation of TCC to adults is 8.6%. In 2007, the number of adults prosecuted on the same charges is 7,275, and the number of children for the same [28] 4. A.B. (Date of arrest: 28.3.2008; duration of arrest 4 months 20 days) 6. E.T. (age 16) was arrested on 21.3.2008 on charges of participating in Nowruz demonstrations, shouting slogans and throwing stones at the gendarmerie; sentenced to a prison term of 4 years 2 months. (Date of arrest: 28.3.2008; duration of arrest 4 months 20 days) 7. C.D. (age 16) was arrested on 21.3.2008 on charges of participating in Nowruz demonstrations, shouting slogans and throwing stones at the gendarmerie; sentenced to a prison term of 4 years 2 months. (Date of arrest: 28.3.2008; duration of arrest 4 months 20 days) For example, F.A. served 6 of the 8 months he was sentenced to while under arrest. Remaining under arrest for 6 months for a penalty of short-term deprivation of liberty contradicts the principle of using deprivation of liberty as a measure of last resort and limiting it to the shortest time possible. For the duration they are deprived of their liberty, children cannot attend school. In the interviews, one of the observations shared by interviewees was that children children and their attorneys that the prisons were full in excess of their capacities, that juveniles held under arrest in the Diyarbakir E Type Closed Prison stay in one ward with 30-35 juveniles, and the population of wards where juveniles arrested for “terrorist crimes” are held varies between 17 and 24. Some arrest durations regarding children the lawsuits concerning whom have been decided within 2008: 1. M.Y. (age 16) was arrested on 9.3.2008 on charges of participating in demonstrations and throwing Molotov cocktails and stones. Subject was sentenced to 6 months for propaganda of an organization, 3 years and 9 months for being a member of an organization, amounting to a total prison sentence of 4 years and 3 months. (Date of arrest 19.3.2008; duration of arrest 2.5 months) [27] 2. A.B. (age 15) was arrested on 9.3.2008 on charges of participating in demonstrations and throwing Molotov cocktails and stones. Subject was sentenced to 6 months for propaganda of an organization, 3 years and 9 months for being a member of an organization, amounting to a total prison sentence of 4 years and 3 months. (Date of arrest 19.3.2008; duration of arrest 6 months) 3. F.S. (age 17) was arrested on 22.2.2008 on accusations of participating in demonstrations organized in Gaziantep and throwing Molotov cocktails and stones; was sentenced to a prison term of 5 years. (Date of arrest 23.2.2008; duration of arrest: still under arrest at the time the report of the İHD Adana Branch was being prepared (January 2009) [26] [3.3] Courts not using arrest and imprisonment as a measure of last resort As with the practice of taking into custody, it is claimed that the rule of “last resort” included in Article 4 of the Child Protection Law and Article 37 of the CRC is not adhered to when it comes to rulings on arrest and prison sentences. The statistical data given below show that the increase in the number and ratio of children received into security units does not extend to the number of children concerning whom an action is filed or court decision is ruled. This makes one think that detention is not used as a measure of last resort. These figures also suggest that there is a serious increase in the number of lawsuits filed on the grounds of violation of TPC Art. 314. In an unofficial source21 it is claimed that suits have been filed for “committing a crime on behalf of an organization although not being a member of the organization” against 251 children in Diyarbakir, Adana, Gaziantep and Şırnak between August 2008 and February 2009, and that 198 of these children are still under arrest in prisons located in different provinces, mainly in Adana and Diyarbakir. According to records of the Bar Association, within the last 1 year, defence attorneys have been requested for 497 juveniles taken into custody on charges of “violation of the Anti-Terror Law” in the events taking place in Diyarbakir. Since judicial statistics do not include disaggregated data on the status of custody according to crime types, it was not possible to make an evaluation in that regard. However, in the provinces visited, it was expressed both by 21 Sabah Newspaper 6.2.2009 is stated that M.B. (age 13) who was taken into custody in the province of Van, has applied to the Van Branch of İHD on claims that he/she was exposed to rough beating and abuse. There are also examples claiming that health conditions are largely ignored.19 It is claimed that 15 year-old Ş.A., who was taken into custody during the demonstrations in Diyarbakir and afterwards arrested, and is currently held at the Diyarbakir Type E Prison, is epileptic and although his/her state of health was notified and relevant medical reports were submitted, the forensic medicine practitioner has issued a report that “the subject’s health condition is not a drawback for detention provided that he/she continues to use his/her prescribed medication”, and that the Court has refused the demands for release based on such report. [25] Often, prolonged hearings can also become a violation of the right not to be subject to ill-treatment. In one of the cases witnessed during the interviews, the children were brought to the courthouse in the morning, yet the hearing did not start until late afternoon. Children reported that they were not provided with sufficient food during this waiting period20. 19 http://www.polisgazetesi.com/yazdir.asp?ID=586 20 Radikal Newspaper 20.4.2009 [24] during the detention process and demonstrated bruises and traces of battery in various parts of their bodies due to this beating and torture, and that his clients had notified this situation in the statements they gave to the prosecutor.17 The ages and custody status of the children who are the subject of this application are as follows: Ü.B. (arrested at age 16), R.S. (arrested at age 16), V.Y. (arrested at age 16), M.Ö. (arrested at age 16), O.S. (16 years old), B.Ö. (arrested at age 15), SK (arrested at age 16), İ.G. (arrested at age 15), M.O. (arrested at age 16), Ö.Ö. (arrested at age 15), M.K. (arrested at age 16), İ.D. (arrested at age 16), Ş.A. (arrested at age 16), L.Ö. (14 years old), Mahir Özdemir (13 years old), D.Ç. (13 years old), E.A. (13 years old), Ö.D. (14 years old), C.K. (14 years old), İ.S. (13 years old), S.Ö. (13 years old). The same report contains information on individual applications made by L.Ö., Ş.Ö. and Ş.A. claiming that the police dragged these children grabbing them by their hair, beat them with batons and verbally assaulted them with insults and blasphemies. And the report claims that in another application, B.E. (14), a grade 7 student at the Primary School of the Seyhan Municipality, was taken into custody on 12.11.2008 10.00 a.m. from his/her classroom18. Security units state that only those who are involved in too many events/activities are taken under custody, while other parties claim that detentions are not always based on a fixed charge. It is claimed by some interviewed that sometimes children seen on the streets during the dispersion of the demonstrators can be taken into custody, that after the recent events police now come and take into custody those children who have stone marks/traces on their hands, and that the apprehension warrant prepared by the police is used as if it is a presumption of delinquency. [3.2] Violations of the right to life and allegations of torture and ill-treatment There are various complaints about ill-treatment and arbitrary practices by law enforcement during detention procedures taking place during or after demonstrations. On the other hand, there are also many children who have lost their lives or suffered injuries during the break-up of 15 Statistics for Children Received into Security Units, 2006, TurkStat Since official statistics for the years 2007 and 2008 have not yet been published, it is not possible to make an accurate comparison. However, it is possible to make an evaluation of the statistics concerning children received into the Child Division of the General Directorate of Security (TNP) in Adana. According to these statistics, 1106 juveniles were apprehended and detained on claims of offending in 2008 by security (law enforcement) forces; 173 of them were detained on charges of organizing unauthorized demonstrations and terrorist actions; also, there are 69 children the charges against whom are unknown since the reason for their apprehension was stated as the apprehension order issued by the prosecutor’s office. The top 3 offense types for 2008 with regard to children received into security units with claims of offending in Adana are as follows: 414 juveniles were detained on charges of theft, 173 juveniles on charges of organizing unauthorized demonstrations and terrorist acts, and 137 juveniles on claims of possession of drugs. Although a reduction is seen in the number of children detained by security units between 2006 and 2008, there is a serious increase in the number of children detained on terror charges. [21] The ratio of the overall number of children detained on terror charges by security units in Adana in 2006 to the overall number of children detained by security units is 0.4%, whereas this ratio rose up to 15.6% in 2008. The age breakdown of 304 juveniles taken into custody on claims of “terrorist crimes” in 27 provinces in accordance with 2006 Statistics on Juveniles Received into Security Units are given in Table 3. [20] ................................................... [3] Implementation Aspects of the Problem [3.1] Detention not used as a measure of last resort Legal practitioners and NGO representatives interviewed claim that detention is used widely and as a measure of first resort for children participating in demonstrations, whereas law enforcement forces are of the opinion that there are many children involved in the events and that investigation is launched only for a handful of them. According to the data of the Adana branch of the Human Rights Association14; in the last 11 months 264 children were detained and 69 were arrested; 105 children were released from Public Prosecutor’s Offices and 95 children were released from detention units. In 2006, the number of children received into security units on claims of offending in the province of Adana is 2,729; 2,648 of them are boys and 121 are girls. Distribution of top three offence types for these children in 2006 is as follows: 832 children on theft charges, 666 children on injury charges, and 241 children on vehicle theft and theft from vehicles. In these statistics, 27 separate offences are categorized, with one category of “other” as well. “Terrorist crimes” is in 23rd place on the list of charges brought against children detained in Adana in 2006. 14 Press release by the Adana Branch of Human Rights Association, dated 29.11.2008 times is likely to be way above these sentences. Since the names of the children are abbreviated to only their initials in the reports, it is not possible to keep track of them. For example, if the names Ö.Ç. and V.Ç. included in the NGO reports regarding decisions ruled in Adana in 2008 refer to the same individuals, then it is probable these children were judged for participation in two separate demonstrations in 2008. According to the report, it is probable that these children were sentenced to a prison term of 4 years and 2 months as a result of the prosecution regarding the demonstrations they participated on 28.12.2007, and a prison term of 1 year as a result of the prosecution regarding the demonstrations they participated on 23.3.2008. The time period involving both demonstrations is around 3 months. Considering that the demonstrations have been continuing since 2006, it can be assumed that there are children who face even longer prison terms. The question of children who face this risk should also be investigated. [19] The adjudications and final decisions ruled in 2006-2007 in accordance with 4 fundamental penal provisions that result in children facing heavy penalties are given in Table 2. (17), sentenced to 1 year for the offence of propaganda of an illegal organization due to having engaged in the propaganda of the organization by carrying an image of Öcalan and shouting illegal slogans at the Nowruz meeting held at the Mimar Sinan Open Air Theatre, 6. V.Ç. (17), and Ö.Ç. (17), sentenced to 4 years and 2 months for the offence of being a member of an illegal organization due to having thrown stones at the police, shouted slogans and burned tyres in the Neighbourhood of Barbaros, 7. M.A.A. (17), sentenced to 1 year for the offense of propaganda of an illegal organization, 8. M.M. (15), and M.K. (16), sentenced to 1 year for the offence of propaganda of an illegal organization and shouting illegal slogans and participating in a meeting organized by DTP for the purpose of supporting Nazmi Gür, an independent MP. In the court decisions mentioned, the lowest penalty is 6 months of prison and the highest penalty is 8 years of prison. Moreover, the total penalties of children who participated in more than one demonstration at different • Resisting the police during the dispersion of the illegal assembly (imprisonment for 5 to 8 years). Hence, the indictments asked for a total of 13 to 28 years of imprisonment for the children. Although these penalties are subject to reduction in accordance with the ages of the children, the reduction by ½ applicable for the 12-15 age group results in 6 years 6 months to 14 years; and the applicable reduction of 1/3 for the 16-18 age group results in around 9 to 18 years of imprisonment as penalty. The reason why children are tried as adults and why it is prohibited to postpone the sentences or convert them into alternative sanctions is explained on the grounds of deterrence. However, as can be seen from the examples given below, there is an increase in the number of lawsuits filed against children for terrorist crimes between 2005 and 2007. [17] Examples of the sentences given to juveniles in 2008, their ages and the actions in which they engaged are as follows12: 1. A.T. (17), sentenced to 3 years 1 month 15 days for the offense of being a member of an illegal organization due to having participated in the demonstrations taking place to celebrate the anniversary of PKK, 2. B.Y. (16), sentenced to 1 year for the offence of propaganda of an illegal organization due to having participated in the demonstrations taking place to celebrate the anniversary of PKK, 3. T.T. (16), M.M. (14), A.B. (16), and S.T. (13), sentenced 12 Retrieved from NGO reports [16] Violation of Law no. 2911 on Assemblies and Demonstration Marches implies unauthorized demonstration and marching. The penalty foreseen for these acts is imprisonment for 1 year 6 months to 3 years. Anti-Terror Law Article 7/2 regulates the offense of engaging in the propaganda of a terrorist organization and provides for punishment of offenders with an imprisonment term of 1 to 5 years. Children can be tried and very heavy penalties can be demanded for one or more of the offenses described above. An example is given below for clarification. Children (Ş.B. (13), E.B. (13), V.D. (13), Ö.S. (14), M.A. (14) and Ş.A.(14)), who are alleged to have attended the demonstrations taking place on the day of the Prime Minister’s visit, are accused of participating in illegal demonstrations in varying areas in the city, throwing stones at security forces, burning tyres, displaying illegal posters and placards, acting as look-out for those burning the tyres, breaking the windows of police vehicles, closing the road to traffic and shouting slogans in favour of Öcalan; and the offenses charged in the indictment are as follows: • Punishment as a “member of the organization” due to having committed a crime on behalf of the organization although not a member of the established armed organization (imprisonment for 5 to 10 years), • Increase of the punishment by half due to the crime having been committed within the framework of the activities of the terrorist organization, • Making the propaganda of the terrorist organization (imprisonment for 1 to 5 years), In 2006, no convictions or acquittals were ruled for the 12-15 age group with regard to TPC Art 220, whereas 6 convictions and 9 acquittals were ruled in the 16-18 age group. In 2007, there were 1 conviction and 5 acquittal decisions for the 12-15 age group. In the same year, there were 14 convictions and 42 acquittals ruled for the 16-18 age group. Article 314 of the Turkish Penal Code regulates the crime of establishing or directing armed organizations for the purpose of committing crimes against state security and constitutional order. The punishment foreseen for this offense is prison for 10 to 15 years. The punishment foreseen for members of this organization is prison for 5 to 10 years. In 2006, 198 of a total of 1,145 suits filed for violation of TPC Art. 314 were against children under 18. 19 of these were against children in the 12-15 age group and 179 against children in the 16-18 age group. In 2007, 215 of a total of 1,094 suits filed were against children under 18. No suits were filed against juveniles in the 12-15 age group for violation of said article. Number of suits filed against the 16-18 age group was 215. [15] In 2006, no acquittals or convictions were ruled in the 1215 age group with regard to TPC Art. 314, while 3 convictions and 22 acquittals were ruled in the 16-18 age group. In 2007, 1 acquittal was ruled in the 12-15 age group, and 31 convictions and 50 acquittals were ruled in the 16-18 age group. Turkish Penal Code Article 152/1a regulates the offense of harming public property and foresees prison sentence for 1 to 6 years for those engaging in this act. [14] is purely play. The following are pointed as justifications confirming this thesis: • Fathers of some of the children are either village guards or police officers, • According to their statements, some of them are children who aspire to go through their education and take up a job in the public domain as a teacher, police officer etc, • The same children give concerts or play ball with the police during the same demonstrations. Source: Police Gazette 06.02.2009 215 out of 1237 actions filed for violation of Article 220 of the Turkish Penal Code in 2006 were against children under 18. 20 of them were in the 12-15 age group, and 195 were in the 16-18 age group. Of a total of 1,232 suits filed in 2007, 207 were against children under 18 years of age. 17 suits were filed against children in the 12-15 age group for violation of the aforementioned article. The number of suits filed against children in the 16-18 age bracket was 190.11 11 http://www2.tbmm.gov.tr/d23/7/7-6037c.pdf • Protesting the authorities for not permitting press conferences by legal organizations such as DTP or İHD or for not permitting marches after press releases, • Demonstrations to protest the apprehension of Abdullah Öcalan or authorities not releasing corpses, • Demonstrations to celebrate Nowruz etc, • Political party meetings. Similarly, in the interviews it was pointed out that the perception of the way children participated in these demonstrations as a manipulation from a single source is not a correct evaluation, and it was emphasized that the children may get involved in demonstrations for widely varying reasons: • Some children are already on the streets and are automatically there during demonstrations, [13] • Such activities are almost the only form of entertainment for children, • For children, acts such as throwing stones etc. are the only known way of expressing their views and protesting something, and there are no other means offered to them for expressing their views, • Children voice their reactions in this manner because of the conditions surrounding them, • Children are invited or summoned to these demonstrations by the organization, • Children are steered by their families. Although these views vary between the parties involved in the issue, there is one view everybody agrees on without exception: the motive of at least some of the children [12] crime on behalf of the organization, even if they are not a member of that organization, shall also be punished for being a member of the organization. b. If the organization is armed, the sentences stated above shall be increased from one fourth to one half. c. Anyone who makes propaganda for the organization or its objectives shall be punished by imprisonment from one to three years. It is claimed that Article 314 of the TPC is applied to all children participating in demonstrations on the grounds of the resolution of the General Penal Chamber of the Supreme Court of Appeals no. 2007/9-282 and dated 04.03.2008. In the said resolution, the General Penal Chamber considered that the fact that the organization (PKK) has issued a general summons to a demonstration constitutes sufficient evidence that the individuals participating in the demonstration have acted on behalf of the organization, based on the view that the principle of “separate responsibility is adopted for any offence committed within the framework of the organization’s activities”. This resolution constitutes the basis for one of the objections of the legal practitioners. The legal practitioners interviewed say that it is not possible to prove the motive of a child participating in demonstrations. In the interviews, it was stated that not all the demonstrations in which children participated were of the same nature, and that all demonstrations, each of which was different in form, are shown and perceived as if they are a uniform illegal demonstration. The demonstration formats in question include the following: • Protests developing in the neighbourhood, dren in 2007 is 63,396. This means that 45% of all children tried in 2007 did not have their trials administered by courts specifically applicable to them. 900 of these children were tried in specifically-designated heavy penal courts. This shows that 0.8% of all children tried had their trials administered by specifically-designated heavy penal courts. In 2005, 1 out of 100,000 children were tried in the specifically-designated heavy penal courts envisaged in CCP Article 250, while this ratio increased to 5 in 2006 and 12 in 2007.10 Conversely, there has been a decrease in the number of children tried in Juvenile Heavy Penal Courts. In 2005, 365 out of 100,000 children were tried in juvenile heavy penal courts, 130 in 2006, and 56 in 2007. The same figure for juvenile courts is 310 in 2005, 747 in 2006, and 600 in 2007. [11] [2.2] Determining the type of offence corresponding to the act Actions against children participating in demonstrations are often filed on the grounds of violation of TPC Art. 152/1-a, 220, 314/2, TCC Art. 7/2 and Law no. 2911. Article 220 of the Turkish Penal Code regulates the crime of “establishing organizations for the purpose of criminal activity”. According to the article: a. Anyone who becomes a member of an organization established for the purpose of criminal activity shall be sentenced to imprisonment of from one to three years. The law also stipulates that anyone who commits a 10 http://www.adli-sicil.gov.tr/istatistik_2007/çocuk/çocuk1c-2007.pdf [10] of the Anti-Terror Law will be considered by the heavy penalty courts specified in paragraph one of Article 250 of the Code of Criminal Procedures (CCP). The same law amendment also prohibited putting off announcement of the verdict, converting ruled prison sentences into alternative sanctions and postponing the sentences with regard to offenses included under the scope of the Anti-Terror Law. The Law adopted the principle of applying this prohibition also for children who have completed 15 years of age. The distribution of children tried in penal courts before and after the law amendment is given in Table 1 according to their age groups and court types. According to these statistics, the number of children whose trials were not administered in courts specifically applicable to chil9 These figures retrieved from Judicial Statistics - http://www.adli-sicil. gov.tr/istatistik_2007/çocuk/çocuk1c-2007.pdf [2.1] The child specific courts rule and trial at specifically designated courts In Turkey, the principle of having children tried in courts specifically established for them was first adopted in 1979 with the “Law no.2253 on the Establishment, Duties and Trial Procedures of Juvenile Courts”. However, this law limited the jurisdiction of juvenile courts to children younger than 15 years old and to offenses falling under the jurisdiction of general courts. According to the said law, children older than 15 years old were being tried in general courts, while children accused of offenses falling under the jurisdiction of the State Security Courts were being tried at State Security Courts (article 6). With the Law amendment of 30.07.2003, this exception was lifted, and the principle that the trials of all children, with no discrimination based on offence or age, should be administered by juvenile courts was adopted. [9] Around the same date, the Ministry of Justice (MoJ) Directorate General for Laws started working on drafting a Child Protection Law, and the prepared Bill was adopted by the Turkish Grand National Assembly on 3.7.2005 and became effective upon its publication in the Official Gazette dated 15.7.2005. This law also adopts the principle that all children regardless of their ages or offences shall be tried by juvenile courts. However, with an additional paragraph introduced on 29.6.2006 to Article 9 of the Anti-Terror Law, the principle of having children tried in juvenile courts, which was adopted with the Child Protection Law, was abandoned. This amendment foresees that actions filed against children older than 15 years old for acts included under the scope [8] reporting the cases. In addition, the Justice for Children Initiative8 was formed with the participation of many nongovernmental organizations. .................... [2] Legal Background of the Problem When the problem is described as participation of children in violence-containing demonstrations and their subsequent detention, arrest and sentence to prison, it becomes necessary to examine the legal arrangements forming the background of the issue in two categories. The first category involves the legal arrangements that allow children to be put on trial at specifically designated heavy penal courts instead of juvenile courts. Initiative www. cocukadalet.com ignated heavy penal courts against 719 juveniles under 18 within the scope of “terrorist crimes”6. In 2007, this number was up to 869 throughout Turkey.7 One of the many demonstrations taking place between 2006 and 2008 was in the Cizre District of Şırnak on 15 February 2008, during which 15 year-old Yahya Menekşe was allegedly crushed under a police armoured vehicle and lost his life. Finally, during the demonstrations taking place in Hakkari in the April of 2009, 14-year old S.T. was allegedly beaten by a police officer resulting in injuries with potential danger of cerebral haemorrhage, 14 year-old Abdulsamet Erip fell down in a creek and lost his life, and 8 year-old Maziye Aslan was allegedly crushed under a police armoured vehicle in Van and lost her life. [7] Since 2006, we witness a large number of children being detained, arrested and sentenced to prison, especially on special days such as the Nowruz on 21 March and the anniversary of Abdullah Öcalan’s capture on February 15th or following various press releases and meetings. Some non-governmental organizations are carrying out activities to create public opinion on the law amendments and raise awareness on the state of children harmed in this process. Human rights NGOs are monitoring and Response dated 06.02.2009 to a written question by the Minister of Justice, Mehmet Ali Şahin. 7 In the source from which these numbers are retrieved, the term “terrorist crimes” is used to indicate offenses of violation of the AntiTerror Law and the acts covered under the scope of Article 301, 220 and 314 of the TPC. 6 [6] children to be used by terrorist organizations, your tears will not avail you tomorrow. Our security forces will make whatever intervention is necessary to stop those who have become the tools of terrorism, be it children or women. No standard of democracy permits such violent events.”2 In the days following these events, a Bill proposing amendments to the Anti-Terror Law to allow children to be put on trial at specifically designated heavy penal courts was brought before the Turkish Grand National Assembly (TGNA) and on 29.06.2006 the Bill was passed and the law came into force. In 2006, a total of 304 juveniles under age 18, of whom 205 were boys and 9 were girls, were detained due to “terror crimes”3 in 27 provinces of Turkey.4 13 of these detentions took place in Adana and 198 in Diyarbakir.5 Statistics for 2007 and 2008 have not yet been published. PART 1 [1] Overview The demonstrations that took place in Diyarbakir in 2006 are a major factor in explaining why children participating in demonstrations started to be seen as a problem and in the subsequent changes made in the legislation which applies to children participating in demonstrations. [5] The demonstrations that started on 28 March 2006 in Diyarbakir during the funerals of 4 alleged members of the PKK killed in Muş continued on 29 March, and during the demonstrations 10 people died, 6 of whom were under 18 years of age.1 Prime Minister Mr. Recep Tayip Erdoğan gave a statement on 1 April 2006 regarding the events, to the following effect: “I call out to mothers and fathers. The study visits were done in cooperation with UNICEF Turkey and the Turkish Prime Ministry’s Human Rights Presidency; officials of public agencies and non-governmental organizations (NGO) were interviewed in the provinces visited.
